Michelle runs, wins and selects Barack to be her VP. The Senate of course will confirm him. After being inaugurated, Michelle resigns, and Barry becomes President for the next four years.

I’ve given some thought to this (when you’re retired you’ve got the time). And I’ve come to the surprising conclusion that CathyWhite is correct.
I would not have bet on that when I first read her post.
I carefully read the 22A. It’s poorly worded. They should have talked about eligibility, and not about being elected. Those are two different things. Eligibility is much stricter, as it even covers possible appointments.
As I noted in my post #83, the Supreme Court would probably not allow anyone to exploit this loophole. But the loophole, it does exist.
But what if President Trump is elected, but the House impeaches and the Senate convicts, and his VP Tucker Carlson is president, but Fox sues Carlson for leaving Fox, before Tucker picks a replacement, and Michelle Obama just walks in and takes over, and picks Kamala, Michelle resigns, Kamala picks Micheal Scott (from The Office), Kamala Harris decides to take a sabbatical, and she makes sure Pelosi is head of the House again, Micheal Scott decides he really loves Jan over Holly, so he leaves Dunder Mifflin Paper so he is ineligible to be VP, so suddenly Pelosi decides to just ‘deems’ herself President, and she selects Vladimir Putin as VP, Putin assassinates Pelosi, and also assassinates Mitch McConnell, but sadly he dies in office, so since there is no VP, and Pelosi and McConnell are both assassinated, it goes to the Sec. of State Blinken, he appoints both Biden and Kamala both President and Vice President respectively, but they both resign, and Nikki Haley decides it’s her turn to be President, and picks John McCain, who is stood up in a chair like Weekend at Bernies, Haley falls out of a window, so Dead McCain is sitting there rotting, and the SCOTUS rules that dead people cannot be President, so the Democrat Party selects Frank Lautenberg, but then they realize Frank is also dead, so Barack Obama decides all of this is crazy, and just elects himself President.
BOOM President Barry.
If it were to happen that she run and is elected her husband COULD NOT be her VP until she is just over halfway thru her term. Constitutionally a president can only serve 10 years minus one day and can only be elected 2X.
An example would be LBJ. He took over the presidency over half way thru kennedy’s term. He then ran and won in 1964 and COULD have run in in 1968. Say he did run in 1968 and won that would gibe him 2 full terms (8years) plus 14 months as president after kennedy was shot.
To go back to your scenario michelle would have to have served OVER half of her term, then have her VP, who couldnt be her husband, resign and THEN appoint her husband as VP and then she resign.

That’s the fatal flaw in your argument right there. I really shouldn’t spill the beans this early, but Trump will be picking me as his VP.

12th Amendment: “But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.”
According to this, the appointed VP would need to be eligible to be the President. So, we have to understand Presidential eligibility; we get that from the 22nd Amendment.
22nd Amendment, Section 1: “No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.”
By serving 2 full terms as President, that individual is constitutionally ineligible to be President again, and therefore also ineligible to be appointed as Vice President.
