Oh, crap. You’ve got a point after all. The Constitution talks about eligibility, as I noted in my post #55. But the 22A talks about being elected, not eligibility. The word “eligibility” isn’t even in the 22A.

This is certainly an oversight on the part of the folks who wrote the 22A. And the Supreme Court would certainly rule that “be elected” in the 22A means the same as being eligible.

But, wow. It is a loophole. And it does exist. So, yeah. It’s worth a conversation.

Yes , if the VP office is vacant, then the president nominates a replacement VP, and that person must be confirmed by both House of Representatives and Senate.

The Constitution does NOT say he cannot serve more than two terms.

It says:

“No person shall be elected to the office of the President more than twice”.

“Elected” is pretty clear. If they meant SERVE, they would have said SERVE!

OR President Trump is elected, but the House impeaches and the Senate convicts, and Michelle Obama just walks in and takes over, and picks Kamala, Michelle resigns, Kamala picks Micheal Scott (from The Office), Kamala Harris decides to take a sabbatical, and she makes sure Pelosi is head of the House again, Micheal Scott leaves Dunder Mifflin Paper so he is ineligible to be VP, so suddenly Pelosi decides Kamala is taking too long, so she just 'deems' herself President, and she selects Vladimir Putin as VP, Putin assassinates Pelosi, and also assassinates Mitch McConnell, but sadly he dies in office, so since there is no VP, and Pelosi and McConnell are both assassinated, it goes to the Sec. of State Blinken, he appoints both Biden and Kamala both President and Vice President respectively, but they both resign, and Nikki Haley decides it's her turn to be President, and picks John McCain, who is stood up in a chair like Weekend at Bernies, Haley falls out of a window, so Dead McCain is sitting there rotting, and Barack Obama decides all of this is crazy, and just elects himself President.
