A grandmother from New Mexico was shot dead by a Los Cruces police officer who fired upon her as she attempted to speed away in her car, shocking newly-released footage shows.

Teresa Gomez, 45, was killed by officer Felipe Hernandez, an eight year veteran with the force in the early hours of the morning on October 3rd, just before 5am.

The cop had been speaking with Gomez who had parked her car at a housing complex with her friend, identified as Julio Garcia.

Hernandez seemingly recognized Garcia from other encounters and appeared to be aware that had been previously was barred from the premises. He began accusing him of trespass and violating a judge's order.

In nine minutes of bodycam footage, Gomez can then be heard being addressed by the officer as he tried to establish her reason for being at the housing complex.

Throughout the interaction the officer can be heard using aggressive language, including profanities, and threatens to 'tase' her and make her life 'a living hell' if she didn't comply with his investigation.

Gomez explained that she was searching for her lost car keys and noted how she was looking for someone at the location.

The officer began to question their presence outside the public housing complex, claiming her passenger was not supposed to be there.

“A grandmother from New Mexico was shot dead by a Los Cruces police officer who fired upon her as she attempted to speed away in her car, shocking newly-released footage shows. “

That’s not what the headline says!

Knowing nothing about the case and having not looked at the video at all, I’m still going to say: Roid Rage meets Attitude.

Sounds like a drug deal was going on and a jacked up cop losing it.

> she attempted to speed away in her car <

This woman was not a fleeing killer, or anything like that. So it all depends on where that car was headed. If it was speeding towards people, then the shoot might be justified. Otherwise, the cop murdered that woman.

And no, I don’t buy the argument that the woman should have behaved herself, so it’s entirely her fault. Sure, she started things. But her actions did not warrant the death penalty.

Well, she was probably sitting in her car as she sped away. But I’m not going to rush to judgment on this one. Particularly with this bit “ recognized Garcia from other encounters and appeared to be aware that had been previously was barred from the premises. He began accusing him of trespass and violating a judge’s order.”

Her rear end sat in the car as she illegally fled in the moving car. That is against the law even for a grandmother.

New Mexico state law....
N.M. Stat. § 30-22-1.1
Current through 2023, ch. 211
Section 30-22-1.1 - Aggravated fleeing a law enforcement officer
A. Aggravated fleeing a law enforcement officer consists of a person willfully and carelessly driving a vehicle in a manner that endangers the life of another person after being given a visual or audible signal to stop, whether by hand, voice, emergency light, flashing light, siren or other signal, by a uniformed law enforcement officer in an authorized emergency vehicle pursuant to Section 66-7-6 NMSA 1978 in pursuit in accordance with the provisions of the Law Enforcement Safe Pursuit Act [29-20-1 to 29-20-4 NMSA 1978].
B. Whoever commits aggravated fleeing a law enforcement officer that does not result in injury or great bodily harm to another person is guilty of a fourth degree felony.
C. Whoever commits aggravated fleeing a law enforcement officer that results in injury to another person is guilty of a third degree felony.
NMS § 30-22-1.1

Laws 2003, ch. 260, § 5.
Amended by 2022, c. 56,s. 27, eff. 5/18/2022.

I still think we should have a national law that says fleeing from the police or resisting arrest gets you 10 years in jail, no parole. Get that law passed and then drill it into everyone’s head. The whole black culture thing of giving the police a hard time and then blaming the police when things go badly should just stop. You gonna give the cops some attitude? That’s 10 years in jail. If we go down that road, a lot fewer people would be shot by the cops.

Why are there so many idiots who refuse to comply with simple directives from police officers? Don't they know how it all ends?

I'm not saying the cop didn't make mistakes, but she quickly escalated the situation.

Headline title: "Shocking moment cop shoots grandmother dead as she sat in her car waiting outside a friend's home..."

First line in the article: "A grandmother from New Mexico was shot dead by a Los Cruces police officer who fired upon her as she attempted to speed away in her car..." I'm guessing it's not poor journalism, but intentional click bait.

I don’t think that is a good idea because human beings are emotional creatures. It’s possible for a completely reasonable person to panic and, there you go. Prison for 10 years. And if there was such a law, a simple “quick attempt”, followed by sanity kicking in and you pull over, could result in an “all or nothing chase because the 10 years have already been “earned”.

"Gomez explained that she was searching for her lost car keys" Then, "sped away"

More happened than is being reported.

So long as you couple it with a mandatory twenty year sentence for any cop shooting a fleeing suspect.

Watched the video. No one in the car’s path, cop not in car’s path, car not speeding.
