New Hampshire Secretary of State David Scanlan (R) is reportedly exploring whether Donald Trump is constitutionally disqualified from running for office.
An increasing number oflegal scholars across the political spectrum argue that Trump is not eligible to hold office because he violated Section 3 of the 14th Amendment, which bars from office anyone who has "engaged in insurrection or rebellion" or "given aid or comfort to the enemies" of the United States.
Scanlan confirmed to the Boston Globe that, after receiving letters urging him to take action, he is considering the possibility that he can bar Trump from the ballot.
"Not being a lawyer and not wanting to make a decision in a vacuum, I will be soliciting some legal opinions on what is appropriate or not before I make any decision," he said.
"I have some in-house staff attorneys that are election experts," he explained. "I will be asking the attorney general’s office for their input. And ultimately whatever is decided is probably going to require some judicial input."
Despite the argument gaining traction in recent weeks, there are significant hurdles standing between it and Trump actually being disqualified from office.
Among those issues are:
What exactly happened on Jan. 6, 2021, at the U.S. Capitol: Was it an "insurrection" or a "riot"? Who gets to decide if Trump is disqualified? Local officials? Judges? What happens when people inevitably interpret the constitutional text and the events of Jan. 6 differently and thus disagree on Trump's constitutional eligibility to run for office? How can Trump be disqualified under the 14th Amendment when he has not been officially charged with insurrection, rebellion, sedition, or even incitement? Soon, we may have answers to some of these questions.

This reminds me of democrat run states trying to kick Trump off the ballot if he didn’t release his tax returns.
These “busy little bees” sure offer a lot of rhetoric about ‘democracy’ but don’t seem to trust the voters, hence the effort to deny voting choices on the ballot.

Section 3 of the 14th Amendment did not SPECIFICALLY alter, negate of nullify the “eligibility clause” of Article 2, Section 1.
If it (14th) was intended to apply to \elected\ members of the executive, it would -as an amendment- have to necessarily alter or nullify the original eligibilities.

This will never pass muster in New Hampshire. This state will do anything to keep its “first in the nation” status.
As a protest to Biden moving the Democrats off of the New Hampshire primary ballot, I’m going to register as a Democrat to vote for RFKJr in the primary.
In the general election, I (we) will vote for DJT for the third time.

It doesn’t apply to the PRESIDENT! So, no. You cannot keep Trump off the ballot.
Everything is industrialized, including the GOP. You have to be vetted as a “certain type” and be willing to stick to the status quo. Those that truly want to change it are not welcome and are pushed down & out.
If you could end all wars you’d be killed. If you could cure cancer they’ll make sure it doesn’t see the light of day. Why should we think the GOP is any different?
The lack of response to the injustice toward PDJT is all we need to see.
I’ll keep saying it, we’re back to “taxation without representation”. Just having the title of “representative” is only that, a title, not by function.
