Actually the fraud probably is that they didn’t have a business license. You can’t have people invest in a business that doesn’t exist. Without the license you don’t have a business. That’s investor fraud.

The Cali Coastal Commission is filled with the most ruthless petty tyrants in any state agency. Unless you are a big lefty celebrity you can’t even fart on your own property without those jerks getting involved.
I have the perfect example of this. The govt organization I was with had over 4 million dollars of excess inventory. Much of that inventory really was not useful, e.g. specialty tools that no one could identify. We sent it to auction and the the total pay-off was less than $40,000. Shipping and packaging to the auction was +$50,000. We all knew this before hand. We asked if we could donate it to a charity if they would pick it up. But no- it might "not look good."
In my young and crazy days, I’ve skipped stones into the water without a permit. Tossed a few, too. They just sink and lay there. No permits at all. Good thing for internet anonymity or the coppers might track me down.
California is governed by idiots. My cousin made slot machine housings and was immensely successful with his business in Truckee, California. As he expanded his operations, California placed so much red tape and hindrance he closed his business, moved it to Nevada and took essential personnel with him and sadly laid off the rest. He liked living in Truckee. He did not want to move his business. California made him move.
Meanwhile in that same Santa Barbara channel there are thousands of gallons of oil leaking out from the bottom of the ocean every year.
