George Washington University Law School professor Jonathan Turley has posted at length about the perils of indicting Trump, namely that most of the charges he could face would be protected by the First Amendment, though he added that the temptation to indict Trump in DC—an anti-Trump bastion—might prove “irresistible” for the Justice Department. He was right, along with the free speech concerns, too.

'People of the United States v. Jack Smith et al.", lol
Yeah, laugh if you must, but think of it as a way of putting these expletive deleteds on notice.
One of the brilliant news people said it was not about free speech...it was about his actions...What action would that be??
Trump’s call for a peaceful protest to address the people’s grievances is and was constitutionally protected rights. The real insurrection is what the democrats are currently engaged in.
Bkmk
this is all a sad joke.
The child molester and frequent taker of bribes is 10000000 times more of a criminal than Trump, who did nothing but fright for election laws to be followed!
They'd be shaking in their boots.
“I know we all have got our doubts about the last election. I want to assure you that I share the concerns of millions of Americans about voting irregularities. I promise you, come this Wednesday, we will have our day in Congress! We'll hear the objections. We'll hear the evidence.”
— Pence, 01/04/2021
I've been thinking about this quote from Pence...
Actually, President Trump can make the very credible claim that it was actually this quote from Pence that incited the riot, and not Trump's January 6 speech.
Trump can claim that nobody knew what he was going to say until he started speaking on January 6.
However, two days before the speech Pence set the expectation "We will have our day in Congress" and gave trouble-makers a two-day lead time to organize and travel to DC.
President Trump can show that on January 6 he implored the crowd to go peacefully to the Capitol and show their numbers. That was an extemporaneous comment made to a already peaceful gathering.
But it was Mike Pence's quote that made the "promise" to personally do something about it in two days ("We'll hear the objections. We'll hear the evidence"). I'm saying that it was Mike Pence who galvanized the people to riot at the Capitol, not Donald Trump.

That’s excellent thinking.
Will he be able to ask why Pelosi stopped the NG from protecting the Capitol?
I don't think anybody would say that Pence was not a "reasonable" person. If Pence said he "share[d] the concerns of millions of Americans about voting irregularities" then it's not unreasonable for President Trump to say that he, too, shared those same concerns on January 6th and believed that he actually won the election.
This is enough to throw out Smith's latest indictments.

Interesting.
I think he knows that his political career is over. However,it’s easy to imagine him getting a huge book deal...if he takes the right course.
Attempts to interfere with an official process, assemblage of alternate electors not chosen by the states or through the voting process for starters.
Mike Pence isn’t concerned about Americans
As we all saw him say
(for the thread)
BULLCHIT!!! How can they be shaking in their boots if they’re winning everything? I’ll tell you what’s going to happen… Trump is asking the Supreme Court to intervene as we type. Do you know what the supreme courts gonna do? They’re going to turn down the case. The jig is up for conservatives ..we will never have a fair break in justice according to the written law! And the reason I say that is because nobody was ever held accountable for the Russian hoax, not even Hillary, who designed the whole damn thing. I hate that bitch …hate her to the core! But she just walked away, scot-free, living on the high along with the Obamas, no one was held accountable. Not even Mueller or Comey …none …ZIP. The only thing if we’re still alive is the joy of pissing on Hillary, Pelosi, Schumer etc.. graves!
My question is why Turley and Levin aren’t on team Trump officially?
Rat Party Headquarters will fight like hell to keep her out of that courtroom.
He implored peaceful once. He also said “We’re going to walk down to the Capitol, and we’re going to cheer on our brave senators, and congressmen and women,” We’re probably not going to be cheering so much for some of them because you’ll never take back our country with weakness. You have to show strength, and you have to be strong.”
I would interpret that as "strength in numbers." President Trump always talks about his turnout and size of the crowd; he always mocks the LAAP-dog media for not turning the cameras around to show the true crowd size at his rallies.
In politics, "strength" means votes and the size of voting blocs. By amassing a large crowd of like-minded people, Trump is sending a message of "strength" by the size of the crowd that assembled to hear him.
It's what Dr. Martin Luther King, Jr., did with his "I have a dream" speech by showing the size of the crowd that he can command.
I'm not intending to compare Trump to King other than to show that it's a compelling show of strength to draw very large crowds compared to others.
