A motorist who refused a breath test when police found her drunk on the side of a busy road has avoided jail after she claimed she didn't start drinking until after her car broke down.
Elizabeth McKnight, 26, twice refused to give the sample after police approached her on a grass verge by her stationary Nissan Qashqai in Chester on August 6.
The mother-of-two, of Bromborough on the Wirral, Cheshire, told officers she'd downed two bottles of wine on the road while waiting for her father to come and collect her after her car broke down.
She also said she had thrown away two empty bottles of wine further up the embankment but officers found no bottles on the verge - instead discovering a near-empty bottle of wine in the footwell of the car.
Inquiries revealed the Nissan was also uninsured.
McKnight appeared in Chester Magistrates Court where she admitted to failing to provide a specimen of breath.
She faced a possible six month jail sentence but was instead given a 12 month community corrections order, had her licence suspended for two years and was ordered to complete 60 hours unpaid work plus an additional 20 rehabilitation activity days with the probation service.
She was further ordered to pay costs and a victim surcharge of £234.
The 26-year-old cited her ADHD, anxiety and dyslexia during the hearing and claimed she was a victim of domestic violence.

Rather humorous, that she is sitting out and away from her automobile. And the local police wanted to breathalyzer test her. It seems she was visibly drunk. There even was a wine bottle in the car.
But she was not driving! So no dice for the coppers.
A life quickly going downhill.

A victim surcharge? You're being victimized, pay 234.
Who was the victim?
It is very common for drunk drivers to say they only had two drinks.
That is just enough to justify smelling of intoxicant but not enough to be over the limit.
Very few admit to the full amount that they had.
Every once in a while they will. The most I heard was two 24 can cases of bear in around 12 hours
Well there you have it, talk about post timing.
"All I had was some beer in teeny-weeny glasses."
"How many teeny-weeny glasses did you have?"
"72!"
Depending on each states laws one could get a conviction on previous operation of the vehicle.

I honestly don’t “get” how people get addicted to smoking or alcohol.
I can’t breath within 10 feet of a cigarette, and alcohol tastes horrible!

This is a fairly common defense when the defendant is found drunk in a non-moving vehicle on the side of the roadway. “My car broke down so I had a few drinks while waiting for assistance”. I rarely works.
Thought that sounded familiar. 😉
It worked for me when I had a wreck.
Of course it helped that I made sure the responding police had to pry the bottle of whiskey from my hand.
Judge reduced the DUI to Reckless Driving, I paid the fine and was on my way.
