A gay couple in New York is suing the Big Apple government because, under the city’s current insurance policy, they did not qualify for fertility treatments such as in vitro fertilization and surrogacy.
Corey Briskin, a former assistant district attorney for the City of New York, and Nicholas Maggipinto claim they have a right to parenthood even though their biology together doesn’t allow for it…

This isn’t a new development. Almost a decade ago, a couple of sodomites conscripted a woman to birth “their child” and then wanted to claim all the massive medical intervention expenses of pregnancy and child birth of the unrelated (tax-wise) woman as a medical deduction on their tax return. So, what’s the answer? Polygamy to make her part of the “marriage?” You cannot cover unrelated people’s medical expenses and expect to deduct those expenses.

If coverage is provided but only to mixed sex couples, NY is discriminating against these two on a basis of gender, in my view, depending on how the coverage is determined and works. If it is only medical effort to restore or support normal biological function then it is NOT discrimination. If it’s outright paying for surrogacy and donated biological resources, NY is in error.
The line is fine but bright and clear. Medical treatment to restore or support basic functions (like a transplant or viagra coverage) is different than medical (mis)adventurism like abortion and transgender sex reassignment surgery.
