An Atlanta-area woman is suing a police officer after he used excessive force, busting down the door to her home and slamming her to the ground as her son watched in horror after she refused to give the officer a chess set that belonged to the former tenant.

Khanay Yancey filed a federal lawsuit against Clayton County and the Clayton County Police Officer identified as Gregory Tillman.

'I was in total disbelief. I was just shocked once the door came crashing in and he [the officer] just grabbed me,' Yancey said as she spoke about the unprovoked attack that took place at Independence Drive in Clayton County in 2019.

Yep.

Once qualified immunity is invoked you can not sue the government employee no matter what.

Even his own department found he was in the wrong. But they did not fire him.

The fact that they at first voted to fire him and then changed that to a 3 day suspension caused me to wonder if that was on the advice of legal counsel either for the obvious lawsuit to come or because of union contracts.

Should also be criminally charged. He committed breaking and entering, battery, illegal detention and probably much more. No reasonable officer would act in this manner.

And if you do get a lawyer that is competent.

Having spent the last hour or so reading the court documents (yes, I am a nerd) it seems he lost because on some things, he did not even argue that he was right.

That is kind of chilling.

If he had a lawyer that had covered all the bases, even though the facts would have remained the same there is a good chance he would have gotten his "qualified immunity".

And since the department declined to give him any thing but a minor slap on the wrist that would have been the extent of his punishment.

For assaulting an innocent woman in her own home.
