Shane William Ryan, 33, claimed an unprovoked attack on a man working out in an NT gym was an accident - until CCTV footage painted a very different picture.
In footage shared by the NT Supreme Court, just before 4pm on October 22, 2020, Ryan and one other man are seen alone inside the Next Level Gym in Rosebery, southeast of Darwin.
The man is seen lying flat on his back, performing a bench press with two dumbbells when Ryan approaches him with a 20kg weight.
“At approximately, 3.52am the victim was lying on his back on a flat bench conducting a dumbbells weight routine,” Justice John Burns said in the sentencing remarks.
“You picked up a 20kg plate and walked towards the victim. The CCTV shows you lurching towards the victim and dropping the weight onto the victim’s head and chest area causing the victim to fall to the ground from the bench, bleeding from his head.
“You feigned an injury to your left ankle before you stood up and walked away before returning to the victim and then calling an ambulance.”
The victim can be seen clinging to his head which had immediately begun bleeding. He had suffered a non-displaced left frontal bone fracture, a laceration above his left eyebrow, swelling to his face, headaches and chest pain, the court heard.
In his victim impact statement, the man said he required ongoing medical treatment, had developed anxiety and needed to take blood pressure medication following the incident.

I could kind-of understand this if the victim was one of those guys who sit on a piece of equipment for an hour reading, or whatever, through their phone, but the victim looks like he is actually using the equipment.
