Speech and guns: two of the most contentious issues in America today, with controversies fueled not only by personal passions and identity politics but by competing interpretations of the Constitution. Perhaps more than any other parts of the Constitution, the First and Second Amendments inspire religious-like fervor in many Americans, with accordingly irrational results.
As legal texts go, neither of the two amendments is a model of clarity or precision. More important, both are deeply flawed in their respective conceptualizations of some of the most important rights of a democratic society: the freedom of expression and religion and the right of self-defense. These two amendments are highly susceptible to being read in isolation from the Constitution as a whole and from its commitments to equality and the collective good. The First and Second Amendments tend to be interpreted in aggressively individualistic ways that ignore the reality of conflict among competing rights. This in turn allows the most powerful members of society to reap the benefits of these constitutional rights at the expense of vulnerable groups. Both amendments would be improved by explicitly situating individual rights within the framework of “domestic tranquility” and the “general welfare” set out in the Constitution’s preamble.

And now for the main point....abortion as it is always with the Left. The inherent desire to be able to murder the unborn....and probably the born in their worldview.
“..What the Sam Hill is she talking about?...”
Don’t ask her...she doesn’t really know. She’s just spouting off some BS she picked up at the “university”.
“..Mary Anne is Exhibit 1 in favor of repealing the 19th Amendment....”
^THIS^
The Amendments known as the Bill of Rights don’t give us any rights. This rights are already ours, endowed unto us by our Creator, or nature if you so believe.
Changing the first two Amendments wouldn’t change that fact. It would only be an attempt to allow government to infringe upon our God- given, or natural, rights.
And to attempt to curtail those rights would be grounds to dissolve a government and establish a new one, per the Constitution of the United States.
scary thing is she’s teaching in a law school.....what do you think the young skulls full of mush are being taught about the Constitution.
The Constitution exists to secure the blessings of Liberty to ourselves and our posterity.
Liberty and equality are antonyms.
How, then, could the Constitution contain "commitments to equality"?
Nonsense talk.
I’ve seen people in this forum use “General Welfare” to mean the government has no limits and can do whatever it wants. I worked with a fellow from Guyana who retired from the US Army and believed the same thing. I hope that this isn’t a commonly held belief, especially among people IN the government.
No... your move.
“what do you think the young skulls full of mush are being taught about the Constitution.”
Same thing pretty much everywhere, which is how we get such GOP losers as Roberts, Kavanaugh, and Barrett on the Supreme Court.
“As legal texts go, neither of the two amendments is a model of clarity or precision. More important, both are deeply flawed in their respective conceptualizations of some of the most important rights of a democratic society: the freedom of expression and religion and the right of self-defense.”
Neither ... is a model of clarity or precision, eh?
Deeply flawed, eh?
Democratic society, eh?
Where does one begin with this, ah, expert? Hmmm, in the final analysis, it isn’t worth it. She already knows everything, and is obviously wiser than Thomas Jefferson and James Madison.
16th, 17th, 19th- Three major errors in the amendments. Together they guaranteed the monster state and ultimately something like a Communist regime. The 16th is probably the most critical. The 19th guarantees the feminization of the nation as women in the aggregate tend to vote for protection for themselves and their children which begets the magerial state with nothing to brake it because of the 16th. That is not compatible with the more masculiine cocept of freedom.
“Pretty sure the Bill of Rights was divinely inspired and any rewrite would be authored by the opposing team”.
Thread winning post!!
Mary Anne Frank, author of “The Cult of the Constitution”.
1st you can say anything you want as long as it’s popular.
2nd you can protect yourself as long as government can disarm you and sanctifies abortion rights.
We want to take away guns from civilians, make islam dominant by suppressing all other religions and then arm the islamists so they can then basically Talibanize the entire country. Free speech and the 2nd amendment right to keep and bear arms is preventing this and we intend to transform the United States.
Mary Anne will eventually end up decorating a lamp post.
And there it is. You think the gubmint has gone off the rails with the phony Covid "emergency"? Just wait until they decide some phantom emergency exists, as in, "too many guns on the street" emergency and then they declare under emergency that all firearms are illegal. And that's when the party really starts.
Whenever Liberals perceive themselves losing they always want to change the rules of the game to tilt the balance FOREVER in their hands. Again we see that the Left never seeks to coexist, they want to crush any and all opposition. It is their inner ruthless fascism that forever wants expression.
Wow…
Just…
…wow.
Dear Mary Anne Franks,
I would redo the first two amendments of the United States Constitution like this…
Any state or federal governmental entity that violates these civil rights will be sentenced to 20 years hard labor.
Sounds good to me.
I dunno…..
“…shall not be infringed” is pretty clear.
... "the right of the people to keep and bear arms shall not be infringed." I don't know anyone could make that more clear.
