Jury awards $10 million to South Carolina woman who stepped on rusty nail at Walmart

A jury has awarded $10 million to a South Carolina woman who sued Walmart after she needed multiple surgeries because of an infection that resulted from stepping on a rusty nail inside one of the company’s stores in Florence, her lawyers said.

“The weakness of Walmart’s case, among other things, was their failure to produce a video that they claim showed their conforming behavior to a company policy calling for employees to perform regular safety sweeps,” the news release said. “No such evidence was presented for the duration of the five-day-long trial.”

So the injury resulted in an infection that led to her leg being amputated below the knee.

It was pure negligence on the part of the Wal Mart store. They admitted they didn’t follow policy about keeping the store clean and free of possible safety issues. They admitted that it was the nail that caused the injury and resulting medical issues. They screwed up start to finish and they’re paying the price for it.

Never occurred to me to sue Kroger.

If it ultimately led to the amputation of your leg would you still have not sued?

The only additional information the article provided was that she had to have her leg amputated and that Walmart admitted that she stepped on the nail in the store. How it all happened is not revealed.

Problem is, what are the “actual damages” of losing a leg? I imagine you are talking about a significant portion of lost wages for the rest of your life, at a minimum.

Walmart is going to argue that poor medical care contributed to anything beyond the original injury. After a few years, and countless billing hours for the attorneys, they’ll reach a settlement far, far short of the original award.

According to the law firm, one of Walmart’s experts testified during cross-examination that the nail was the cause of the injury.

Why according to the attorney? Is there no transcript the intrepid reporter might check to corroborate?

So, was she going barefoot in the Walmart? If so, what happened to “shirt and shoes required”? The rusty nail pierced through her shoe (or house slipper) and entered her foot? Enquiring minds want to know.

Well, USAF-issue combat boots were no match for the nail I stepped on. Went right through the "heavy-duty" sole and into my foot. Headed to the base hospital for a tetanus shot and a bandaid. Was back at it in a couple of hours.

Exactly. How does one manage to get a rusty nail through a shod foot in a Walmart?

By stepping on it. I got one through my combat-boot-shod foot in Korea 30+ years ago.

Then i went home.

there are people that intentionally spill liquid on the floor of a store, then do a fake fall, so that they can sue the store. I knew a person who tried to do that.

I’ve known this for decades. You are more likely to catch tetanus from a clean kitchen knife then you are from a rusty nail.

If there is no video.....how do they know it was Walmart It could have been anywhere?

It's not a question of occurring at Wally World, the "no video" argument is that WalMart wasn't doing safety/cleaning sweeps every so often like their store policy says they should. So the argument is that there's no video showing any employees walking around with a broom all day.
