How can they, there is no rule to challenge in court.
There is no published mandate from OSHA....yet.
Can any employer ask an employee if they have HIV? Hepatitis? If they are receiving treatment? What kind?
Next EO he signs will be for the termination of America.
Supposedly OHSA sent it to the White House a week or two ago, but it hasn’t been issued.

but to answer the title, First the rule has to be put in place (not currently in place) and THEN someone can file a lawsuit.
I am hopeful that the whole thing will be struck down before it takes full effect. Pretty sure it has zero to do with HIPAA/HIIPA/HHIPA.

It doesn’t violate HIPAA. Whether or not it’s constitutional remains to be seen.
Can an employer ask existing or newly hired employees for their personal medical vaccination records to see/ensure that they are up to date with ALL their shots?
Kinda problematic when the same gov’t entity compelling employees to get vaccinated also states plainly they are not interested in reports of employees suffering adverse effects from that vaccine.

Nothing yet to fight against. I recall reading an article (sorry, no link) that said maybe in November sometime. Maybe later.
However, I suspect there are hundreds, if not thousands, of objections sitting on lawyer’s desks, waiting to be fleshed out when the final ruling is released.
This fight will be dammed interesting. Of course I hope the entire thing gets tossed in file 13.

I asked my boss at work last week. She said upper management is in discussion with internal and external legal as to how to implement. I asked if OSHA has implemented anything...she said there was an EO.
Don’t shoot me...that’s what she said.
Nobody can rule on it until the mandate actually happens and somebody with standing files a lawsuit. Hopefully when that happens, a judge will issue a court order to stop the mandate from being implemented while the case is litigated, but that is up to the individual judge who gets the case.
