Biden Regime To Mandate Vaccine For All Military Personnel By Sept. 15, Refusal Is Grounds For Court Martial
National File ^ | 08/09/21 | Gabriel Keane

The United States military, under the direction of Biden regime Secretary of Defense Lloyd Austin, is moving to require all service members to be injected with the COVID vaccine by September 15, according to a report from the Associated Press. Refusal to be injected could be treated as failure to obey an order, and unvaccinated soldiers may be subject to punishment under the Uniform Code of Military Justice.

“I will seek the president’s approval to make the vaccines mandatory no later than mid-September, or immediately upon” approval by the Food and Drug Administration, Defense Secretary Lloyd Austin declares in a memo to troops obtained by the Associated Press. “I will not hesitate to act sooner or recommend a different course to the President if l feel the need to do so.”

The requirement could be moved up to an even earlier date if ‘infections continue to rise,” and restrictions such as “wearing masks, social distancing and travel limits” will apply to unvaccinated service members in the interim. The Associated Press reports that “Military officials have said that once the vaccine is mandated, a refusal could constitute failure to obey an order, and may be punishable under the Uniform Code of Military Justice.”

National File previously reported on Austin’s push to make all members of the U.S. military become vaccinated:

Secretary of Defense for the Biden Administration Lloyd Austin is set to announce mandatory COVID-19 vaccinations for all active duty troops at the direction of Joe Biden, according to a report from CNN. “Defense Secretary Lloyd Austin is expected to seek authorization to make Covid-19 vaccines mandatory for all active duty troops as soon as this week, following President Joe Biden’s directive that the military examine how and when it could make that happen,” CNN reported.

If the secretary makes that final recommendation, he could seek a presidential waiver to allow the vaccine to be administered to troops before full approval by the Food and Drug Administration. A Pentagon decision and recommendation on how to proceed could come this week, several officials say.”

Service members who have not yet taken the vaccine have been subjected to forced testing and quarantine, as well as compulsory mask wearing.

Challenge what later if you took the shot, it is too late to challenge later. it is done.

I was trying to see what you meant by challenging it later.

Granted...

I meant the military that refuse to comply to take the jabs. So if they get any other type of discharge other than honorable. They should challenge it.

Astounding the Pentagon is trying to make them take an experimental against their W=will. It’s terrible.

More false and misleading anti-vaxxer propaganda. The ‘Nuremburg Code’ is not a part of US law either by legislation or Treaty.

“The anthrax vaccine was EUA when the order went out that it was required.”

And the DoD was later sued and a court held that as long as the drug was under a EUA, it could not be required. (John Doe #1 v. Rumsfeld, 2003). The Courts-Martial were from prior to that decision. The statute that allows an EUA specifically says it requires informed consent to use and experimental vaccine or treatment. And the Nuremburg Code prohibits performing medical experiments on patients without their consent. As long as the vaccine is classified as “experimental”, the patient must freely consent, without any coercion or threat of retaliation or retribution for refusal, for it to be legal.

Could having a record of “court martial” during this time period become a badge of honor?

- There is no such statute. It’s regulation.
- The Nuremberg Code is not codified in any legal jurisdiction on earth.

US Law allows POTUS to issue a waiver for EUA. Once done, the military can order a member to take the shot. Those who refuse are subject to Article 92 prosecution.

Voluntary or not, those that have already refused have essentially terminated their career progression if their CO is pushing the vax to make his or her superiors look good. The pressure must be intense. I can’t believe there are 40% or whatever it is that have refused. It’s really easy to write bad performance reports on the un vexed if they so wish. So IMO the unvaxed, if they intend to remain so, should try to separate ASAP. Find a lawyer. Try for an administrative discharge.

You are wrong. Enlisted and Noncoms do have the potus clause in oath. Officers take a different oath. See the link below for the officers oath.

https://history.army.mil/html/faq/oaths.html

“I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.”
(Title 10, US Code; Act of 5 May 1960 replacing the wording first adopted in 1789, with amendment effective 5 October 1962).

According to the U.S. Army of Military History:

The wordings of the current oath of enlistment and oath for commissioned officers are as follows:

“I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.”

The last branch of the business I was attached to was the DOD. Before that, the department of the army. And before that, the Air Force. Retired disabled from the first and third respectively. Could have done the DOA, but I’m not greedy. Happy with what I got. It pays the bills.

You missed a very important part of the ruling potus can issue a waiver for informed consent it’s in the ruling itself. This potus can and will issue that waiver but it will be irrelevant as the FDA is going to approve Pfizer and Moderna by Sept 15th. Second point is the UCMJ also has article 134 that we can and will throw at a solder if they refuse to comply with an order of a superior. We Court marshaled 4 guys from my provost marshals unit no less for refusing anthrax every one of them was an article 134 and or article 92 charge and all were given BCDs

https://biotech.law.lsu.edu/cases/vaccines/Doe_v_Rumsfeld_I.htm

“The women and men of our armed forces put their lives on the line every day to preserve and safeguard the freedoms that all Americans cherish and enjoy. Absent an informed consent or presidential waiver, the United States cannot demand that members of the armed forces also serve as guinea pigs for experimental drugs.

.....

Pursuant to Fed. R. Civ. P. 65 and for the reasons stated by the Court in its Memorandum Opinion docketed this same day, it is this 22nd day of December, 2003, hereby

[85]ORDERED that the Motion for a Preliminary Injunction is GRANTED. In the absence of a presidential waiver, defendants are enjoined from inoculating service members without their consent; and it is “

“My oath for 25 years was to ‘support and defend the Constitution against all enemies, foreign and domestic, ...”

I agree as foreign and domestic was in there too.

§ 502. Enlistment oath: who may administer

(a) ENLISTMENT OATH.—

Each person enlisting in an armed force shall take the following oath:

‘‘I, llllllllll, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.’’

https://www.govinfo.gov/content/pkg/USCODE-2011-title10/pdf/USCODE-2011-title10-subtitleA-partII-chap31-sec502.pdf

It falls under title 10 and 5 USC in civilian laws.

I gave another site to another Freeper in my last post. But they both confirm President and officers appointed above me.

I’m always open to suggestion. Please find another site that doesn’t use the president or above officers. I took the oath for 21 years, then went to work on the civilian side.

There are some offices that don’t use the president within the oath. The president’s oath and the supreme court’s oath are two of them. But most use the president and officers appoint above me.

I never once swore an oath to the President, as I was a commissioned Officer in the US Navy.

You are wrong. Please do a bit more research.

Commissioned Officers don’t use that oath. Just a bit of research would reveal that.
