In Heated CNN Interview, Avlon Fights Defense Lawyer for Capitol Riot Defendant

In a heated interview on CNN's New Day this morning, Joseph D. McBride, the lawyer for Capitol breach defendant Richard 'Bigo' Barnett—famously seen with his feet on a desk in Nancy Pelosi's office—condemned the conditions of detention for the defendants, labeling them "D.C. Guantanamo Bay," and repeatedly accused the authorities of "torture."

Snide and smirking substitute host John Avlon took repeated shots at McBride, claiming that McBride's various arguments "make absolutely no sense," and are "utterly unbased in fact." In a parting shot, Avlon sanctimoniously said, "I had hoped you would have a more of a fact-based conversation with anything resembling a sense of perspective about an attack on our Capitol."

“The man put his feet on the Speaker’s desk”

I don’t see jail time for that. Could you give a fuller explanation of the basis for 8 months in jail? Could be that he was considered an accessory to an attempt to overthrow the government?

Not really trolling. Scripture says to respect authority, even Nero. Plus there’s this invisible book titled Things Wise People Don’t Do.

the fact that there is no controlling legal authority, leaves all actions ultimately unaccountable.

Why has habeas corpus been suspended for the trespassers?

I had not heard that this had happened. Habeas corpus means, as I understand it, that the government can't just arrest people and jail them without a charge. The 1/6 defendants have been charged.

Charge them with a crime, allow them to plea, post bail, then try them if necessary. That’s our system.

I agree, and AFAIK that's what's been done in the 1/6 cases. The system does provide that, under limited circumstances, the judge has the authority to deny bail (notably, if the defendant is a risk of flight). Bail has been denied in a few 1/6 cases just as in a few non-1/6 cases. That's part of the system, too.

So what am I missing?
