Trump files a class-action lawsuit against Facebook, [...] and calls for punitive damages for 'cancel culture' victims
U.K. Daily Mail ^ | 7/7/2021 | Bob Crilly

Posted on 07/07/2021 10:16:37 AM PDT by simpson96

Former President Donald Trump announced on Wednesday he was launching a class action law suit against Facebook CEO Mark Zuckerberg, Twitter CEO Jack Dorsey and Google CEO Sundar Pichai on behalf of victims of 'cancel culture.'

He demanded the end of 'shadow banning,' and 'blacklisting' as he stood in the blazing sun, using his Bedminster golf course clubhouse as a backdrop.

'In addition, we are asking the court to impose punitive damages on these social media giants,' he said. 'We're going to hold big tech very accountable.'

Trump will serve as the lead plaintiff in the suit, claiming he has been wrongfully censored, he added.

His lawyers say they will argue that Congress has frequently pressured Big Tech to take action on conservatives, making them 'agents of government' and therefore subject to the First Amendment.

The legal moves are backed by the America First Policy Institute, a non-profit that includes several former senior administration officials.

Trump accused the mainstream media and politicians of cozying up to big tech.

'There is no better evidence that big tech is out of control than the fact that they banned the sitting President of the United States earlier this year, a ban that continues to this day,' he said.

He contrasted his position with hate speech coming from Iran and Palestinian hardliners.

'Hamas, as I said, the greatest killers in the world, have a site,' he said, saying the tweet that got him banned was innocuous.

'Get the quote, you won't believe it.

'But these people call for the destruction of Israel, the destruction of the USA, nothing happens to them.'

I can already hear a whole series of sold-out judges intoning “No legal standing” while file thousand of words long gooblly gook briefs.

But on the other hand as a matter of recording a petition for the redressing my grievance against a platform that presents itself as a protector of free speech, I want in.

Everyone who has been banned or shadow banned should join in the suit. The more the merrier. Especially those who were demonetized.

"Why do I see this suit being tossed for “no standing”?"

Maybe because recently out Federal courts have consistently ruled that "We The People" have "No Standing" in our own courts that "They" have decided belong strictly to "Them".

To use any of these sites you need to agree to their terms and services. That functions as a contract. All of them demand the right to do whatever they want, and for you to surrender the right to sue them.

Contracts have to abide by the laws, such as Section 230, anti trust laws, campaign finance laws and the Constitution.

"I would love to see him win this but I doubt it will see the light of day. Too much corruption with lawyers, judges, and the court system."

One of the reasons we had our Revolution was the high costs of justice in colonial American. So here we are right back where we started.

If done correctly this will get to the SCOTUS if not properly adjudicated in the lower courts. I believe they are filing in a "friendly" court in Florida to kick it off. The will need $$$ in donations as the big 3 literally have unlimited funds to fight this.

Wouldn’t it be a hoot for everyone with an account with one of those sites to go now and troll to be censored, fact checked, or blocked by posting unapproved (but true) thoughts.

The most it would cost you would be a few seconds of your time, but you could share in a settlement potentially worth billions of dollars.

Even if nothing came of it, just think what all those posts would look like.

“he has standing”

Says you, but your opinion doesn’t count, only the corrupt court opinions count.

Excellent. That’s how it’s done.

They can either be a public forum and not exclude people and enjoy the protections; or they can be a publisher and exclude all they want.

They can’t be both, legally.

I think the legal argument is you can’t be both a public forum and enjoy those protections and a publisher when you decide to change your cloak and enjoy those protections.

Pick one.

Anyone have a list of lawsuits filed by Trump that he’s won?

Are Trump’s claims really “typical of the claims . . . of the class”? I have a hard time seeing how he is an appropriate class representative.

I hope Trump can afford this lawsuit. He’s trying to raise funds for it.
