Trump files a class-action lawsuit against Facebook, [...] and calls for punitive damages for 'cancel culture' victims
U.K. Daily Mail ^ | 7/7/2021 | Bob Crilly

Former President Donald Trump announced on Wednesday he was launching a class action law suit against Facebook CEO Mark Zuckerberg, Twitter CEO Jack Dorsey and Google CEO Sundar Pichai on behalf of victims of 'cancel culture.'

He demanded the end of 'shadow banning,' and 'blacklisting' as he stood in the blazing sun, using his Bedminster golf course clubhouse as a backdrop.

'In addition, we are asking the court to impose punitive damages on these social media giants,' he said. 'We're going to hold big tech very accountable.'

Trump will serve as the lead plaintiff in the suit, claiming he has been wrongfully censored, he added.

His lawyers say they will argue that Congress has frequently pressured Big Tech to take action on conservatives, making them 'agents of government' and therefore subject to the First Amendment.

The legal moves are backed by the America First Policy Institute, a non-profit that includes several former senior administration officials.

Trump accused the mainstream media and politicians of cozying up to big tech.

'There is no better evidence that big tech is out of control than the fact that they banned the sitting President of the United States earlier this year, a ban that continues to this day,' he said.

He contrasted his position with hate speech coming from Iran and Palestinian hardliners.

'Hamas, as I said, the greatest killers in the world, have a site,' he said, saying the tweet that got him banned was innocuous.

'Get the quote, you won't believe it.

'But these people call for the destruction of Israel, the destruction of the USA, nothing happens to them.'

I sure hope he wins this suit. Won’t be holding my breath though.

Why do I see this suit being tossed for “no standing”?

Would love to see him win, but I need to see the legal arguments.

To use any of these sites you need to agree to their terms and services. That functions as a contract. All of them demand the right to do whatever they want, and for you to surrender the right to sue them.

Trump has good lawyers, and they may have found a loophole, but big tech can afford the best lawyers in the world.

There was absolutely no reason to cut off the President of the United States from the public...because they say they can.

No standing. Dismissed without comment.

There simply is no more rule of law in this country, and no one is holding liberals accountable while conservatives are persecuted.

I wish I could join the suit, but far as I know I have never been banned by the defendant companies. Of course, I’ve never joined Twitter, have only a small anonymous presence on Facebook for horse racing info, and don’t have anything Google would be interested in far as I know — except, of course, info about me that they mined (stole) from my legitimate online activity.

One of the biggies is that he is a Public Figure. If they shut down one....then they must shut down all. We’ll see.

This lawsuit goes outside the box by showing a partnered effort by the Rats with totalitarian Big Tech.

It’s a very good play.

If he loses the case...he is constantly exposing the greedy creeps who run a glorified BBS. if he wins...alternative sites will get more traffic and he gets the creeps to lose money. Either way, he is fighting. Either way it exposes those who side with big creep tech and anticonstitutional censorship.

“big tech can afford the best lawyers in the world”

Lawyers are for the peons. Big Tech can afford Judges, and Branches of the gov’t. Why leave anything to chance?

I would love to see him win this but I doubt it will see the light of day. Too much corruption with lawyers, judges, and the court system.

Fantastic strategy. Win or lose, the important thing is that this man FIGHTS. He does not lay down and roll over like so many. GIVE THEM HELL!!!!

I think the question of judges will be decided upon the filing. Trump will nit file in a court that will declare he has no standing. Also, he will file where he has an appellate court advantage

Trump will use a weaponized court turn about’s fair turn

“..To use any of these sites you need to agree to their terms and services. ..” the problem becomes when they toos people out because of their opinion it brings them into a new category. Akin to a Baker saying they wont bake a cake for a gay wedding.

“..Standing is the ability of a party to bring a lawsuit in court based upon their stake in the outcome..” he has standing, he can show damages, and because there were/are others they will all be part of “the Class”. look to the asbestos suits being filed even now.

This may be the opening move of a larger play. I don’t see Trump pinning all his hopes on just one strategy, especially one that depends on lawyers and judges.
