Appeal and reverse. It’s unconstitutional.
Time to go after those companies that force this on their employees.
This needs to go to the USSC. We shall see. I’m sympathetic to the argument of changing terms of employment. (I wonder if they would be compelled to take the flux vax.) I am also sympathetic to the employer concerns over potential COVID outbreak (but not nearly as much).
Appointed by Ronald Reagan
Forget the Nuremberg angle.
How is it not a hipaa violation to force employees to disclose medical information?
US District Judge Lynn Hughes was not sympathetic to either argument, writing in his order of dismissal Saturday evening that none of the employees were forced or coerced to take the vaccine. He also noted that the hospital cannot violate the Nuremberg Code because it is a private employer, not a government.

This judge is a moron. By his logic, a private employer could mandate anything they wish. They can force you to take experimental vaccines as a requirement of employment. Perhaps the employer would dictate what you eat, where you live, who you associate with, how you spend your free time.
What if the terms of employment includes a “casting couch”. Just go “work elsewhere”? /s
How would the judge feel if he were not allowed to perform his job, without submitting to an experimental injection for a virus that over 99 percent of people survive?
Childish wording for a lawsuit and bad analogy really. They should have just brought up the fact that it's EUA and also show VAERS data. They could have also shown Pfizer and Moderna's own trial protocols that state that Phase 1 of the trial was/is for a 24 month period and that the protocols were written a year ago. Phases 2/3 were to be another 24 months. COVID itself has only been known to be in the USA for just over a year.
“He also noted that the hospital cannot violate the Nuremberg Code because it is a private employer, not a government.“
It’s not private if it accepts government cash. It’s not private if they are forcing shots and the government assists in the coercion.
But woe unto them if they use the wrong pronoun. Then you can sue the hell out of 'em.
I lost my job yesterday because I refuse to get vaccinated. I can’t get flu shots because of allergies (almost died after my one and only) and I had a horrible reaction to my second shingles shot. Still having problems four years after that one.
I work in higher ed. Schools are not allowing anyone without vaccination on their campuses.
In the US, companies are allowed to act as tyrants, to a point. The workers’ lawyers should’ve found that point, in precedence.
Failing that, states need to write more specific laws protecting people from employee tyranny like this.
Also, many of their colleagues in Houston used medical or religious grounds successfully.
Nuremberg won’t work anyway when/if the FDA approves this.
All hail the New World Government!
Flu shots are required of hospital workers too
Since when do you have to take a vaccine against your will. When did employers have the right to your body?
Who are their attorneys?
Why did they even bring up the “Nuremburg Code”? Is that American law?
The US Code, Title 18 presumably, in any event Federal Law prohibits forcing anyone to take an experimental vaccine, or take part in clinical trials, or be coerced in any way. The End.
Sounds like they got bad dope. Can anybody read anymore?
Can’t fire as long as vaccines are EUA.
Can’t fire if they’re unionized.
And I’m betting the last thing this health system wants is a court case that leads to some very interesting discovery.
Note to employees: Sue.
You’ll be doing yourselves and the country a great service.
Will these judges be responsible for the deaths of these Americans who are faced with losing their job over forced injections? All I know is there are now hundreds of thousands who have violated the Nuremberg Code against forcing participation in experiments on the human body. And losing one’s job to avoid being experimented on is not a valid choice under the Code. What an insane world we live in.
