A number of White House staffers were asked to resign or demoted for past marijuana use — regardless of whether those employees had been in one of the 14 states where the drug is legal, according to a report.
The Biden administration had required workers to disclose past marijuana use on a background check form, but told some new hires that it would “overlook” those who answered yes, the Daily Beast reported.
Despite this, White House director of management and administration Anne Filipic reportedly led a series of one-on-one calls with staffers this month, asking those who admitted to past marijuana use to resign or be placed in a remote work program.

The OPM Standard Form 86 - the lengthy document applicants complete to obtain a national security clearance - requires disclosure of the recreational use of marijuana at any point in the last 7-years, even in a state where’s it’s technically ‘legal.’ Applicants are instructed that such a disclosure is potentially disqualifying.
I’m not sure if under the existing statutory and/or administrative law, Biden could waive that even if he wanted to. If it’s statutory, then certainly not. But, if it’s an administrative directive (slightly different than an Executive Order), there’s a process that needs to be strictly followed before that can be changed. Trump & Obama both were undermined by the Supreme Court when they tried to unilaterally edit/end varying administrative laws. Biden likely wouldn’t be any different.
Reasonable people can debate the propriety of marijuana prohibitions. But, a lot of people, young people in particular, don’t realize that even though their state may have ‘legalized’ marijuana, the drug remains on the Schedule III list for federal purposes. Any use of the drug can have real federal consequences, still.
Does that mean Biden will ignore anything Obama suggests, and forbid his staff idolizing Obama?
