A couple things would have happened if Pence unilaterally ignored the election results in the Senate.
1) The Democrats would immediately sue and it would go before the Supreme Court within 24 hours and overturned. Even a Republican Majority could not allow it as it would create the Precedent of any future Democrat Vice President being given the authority to unilaterally void an electoral college and Congressional certification vote. It was always a ludicrous argument.
2) Pence would be promptly impeached by Pelosi and likely would have to resign or face a Senate trial.
The only thing it may have done was stop the riot and insurrection and make Pence a folk hero to millions and likely 2024 front runner in the primary. It wouldn't have given Trump a second term though.
Rush Limbaugh is not under the control of the media. Neither is Glenn Beck or Sean Hannity or Mark Levin or NewsMax or the big screens President Trump had at his rallies or youtube (at the time anyway). There were plenty of ways to get the evidence out.
Wisconsin State Legislators wrote to Pence telling him their vote count was fraudulent and to not certify their state. This was well before Wednesday January 6th.
Agree.
“But they would have to review what Pence sent back and then not only highlight the fraud but also go on public record to support the fraud very different then just not sending a letter duh”
Repub leaders of the Michigan legislature had made it very clear they think Biden won the state. They would have had no issue with selecting electors who would have voted for Biden.
The theory was ludicrous from the get-go.
The only method by which Vice President Mike Pence could have rejected the Biden electors was if the individual STATE LEGISLATURES had OFFICIALLY reconvened themselves into session (by a 2/3 or 3/55 majority, depending on the state in question), and then sent a competing slate of electors, of THEIR choosing, to Congress, in opposition to those electors certified by the state’s governor and Secretary of State. No other legal avenue ever existed, except in the minds of the deluded “Q” cultists.
Signed letters, sent to Congress from legislators of several states, making requests that the certified electors be sent back to their assemblies for reconsideration, do not equate to the decertification challenge that is necessarily required from the state assemblies in session.
The contrary arguments were the product of a “Q” Anon disinformation campaign that was launched through its various outlets on social media - and specifically from megaphone “Q” adherents, attorneys (not for long) Lin Wood and Sidney Powell.
Moreover, the breech of security and violence that ensued at the Capitol on January 6, 2021, was a direct action planned and acted out by “Q” cultists, who were the majority of the offenders present, among other actors from assorted fringe groups, several of whom are opposed to President Trump.
Further, it is of paramount importance to understand that the initial breech of the Capitol Police barricades, and the criminal acts which followed that breech, were perpetrated by a relatively small group of individuals, who were NOT PRESENT AT THE ELLIPSE DURING PRESIDENT TRUMP’S SPEECH. THESE INDIVIDUALS DID NOT HEAR HIS SPEECH. IN FACT, THEY ARRIVED AT THE CAPITOL WHILE PRESIDENT TRUMP WAS STILL SPEAKING, AND BEFORE ANY OF THE TRUMP CROWD COULD REACH THE CAPITOL GROUNDS.
THE GREAT MAJORITY OF WHAT HAPPENED THAT DAY IS LAID AT THE DOORSTEP OF THE “Q’ CULT - AND THIS IS WHY THEIR ADHERENTS SHOULD BE BANNED FROM FREE REPUBLIC.
RE: In 2016, the electors of Michigan voted for PDJT but by your definition, they would have illegal as as they were sent up by the governor and not the state legislature as required by the Constitution.
YES they were. The Michigan legislature SHOULD NOT ABDICATE the powers given to them by the constitution. A lot of this mess we are in right now came as a result of legislators not following the law and ABDICATING their responsibilities.
In the case of 2016 however, the governor and the legislature were IN HARMONY. Which means that BY A HAPPY COINCIDENCE, even if the legislature did their job as they should, Trump would still be elected in the state.
In 2020, IT WAS DIFFERENT. The legislature and the governor were NOT IN AGREEMENT on the electors to choose but the legislature ABDICATED their authority.
But wrong is still wrong (2016 or 2020 ) and we have to insist that every state follow the law for 2024.
There were no disputed states. Not a single state legislature rescinded its electors or superceded them with competing electors.
The legislators had weeks to do so and did not.
You can’t reason with these idiots.
WHAT competing slates? Electors aren’t self-appointmented. Did the legislature of Michigan or Arizona or Georgia or Pennsylvania or Nevada or Wisconsin rescind their original electoral slates when no one was watching?
The House voted late Tuesday to approve a resolution begging Vice President Mike Pence to trigger the 25th Amendment and sideline President Trump, a largely symbolic spanking that was a prelude to a bigger fight over impeachment.
The 223-205 vote saw one Republican, Rep. Adam Kinzinger, join with Democrats.
Democrats said the urgency of removing Mr. Trump after last week’s attack on the Capitol demanded action by Mr. Pence.
Those “serious concerns” came individual legislators or legislators acting in concert as rump legislature. No state legislature moved to rescind its electoral slate.
Uh no Pence should have rejected the states with competing slates of electors and directed those states legislatures to straighten out their problems and then certify.
Sox states? Those would be Massachusetts (Red) and Illinois (White.)
Heheheheh. You’re toast here. Good luck with it.
Did you just get here? There were NO competing electors. If electors could self-appoint I’d have been one or two or three.
Incoming!
None of these audiences needed to see it. The audiences that needed to see it were the ones who believe the regular news liars.
The legislatures were out for a month and were just getting back into session on Jan. 6.
That's when leaders in four state legislatures sent letters to Pence.
Okay. You win.
