Do you think the Democrats regret talking about packing the Supreme Court?
A lot of people were shocked when the Supreme Court agreed to hear the lawsuit by the State of Texas against Georgia, Michigan, Wisconsin, and Pennsylvania for allegedly exploiting "the COVID-19 pandemic to justify ignoring federal and state election laws and unlawfully enacting last-minute changes, thus skewing the results of the 2020 General Election." According to media reports, Louisiana and Alabama A.G.s, and possibly six other states, have expressed interest in joining Texas in the lawsuit.
Many legal scholars dismiss the chances of success for the lawsuit, and even sympathetic observers such as John Hinderaker of Powerline term the suit a "Hail Mary" move, even though it is "plausible from a legal standpoint," because "the likelihood that the Supreme Court will seriously entertain the idea of overturning the apparent result of the election is far-fetched."
I am not a lawyer and will leave to others far more qualified than I to debate the intricacies of constitutional jurisprudence. My concern here is the other factors that may well weigh on the minds of the nine justices of the Supreme Court.
It's been more than a century since the words "[t]he Supreme Court follows the election returns" entered the nation's consciousness, meaning that it is naïve to believe that the Court acts solely on the basis of legal reasoning and precedent. I am looking at the case from the standpoint of the Supreme Court as a political body, one that cloaks its actions in the veneer of legal reasoning but that ultimately is well aware of the political background and consequences of its actions.

With 18 states (the audacity of Arizona joining the suit is bitter irony) joining amicus to this suit, NOT hearing the case would be a massive capitulation to the reality that the Constitutional Republic experiment in the US is over for good.
With Alito, Thomas, and Barrett now on the court, I don’t see their not finding for Texas here a logical possibility. The case is so simple and clear, and its based on 14A which we have driven a fleet of trucks through (penumbras and emanations from 14A to see a women’s right to kill their own children).
Because it is 14A, and because the argument is that the 18 States interest here is in the election of VICE PRESIDENT, there isn’t a whole lot of wiggle room.
The State’s case is allowing 6 states to illegally alter election law harms the interests of the other states in the Senate, where it is often the case that the VP is the deciding vote. Full stop.
It’s goes to the original reason the 14A was written.
The remedy for the states here is also black-letter - let the legislatures in the states fix the problem. Done. No new law, penumbras, emanations, hanging chads. Done.
Then it is simply up to the state legislatures to fix it by electing their own slates.
IF THEY CAN’T DO THAT IN TIME, then the solution is also black-letter (and has precedent in the Hayes election): it goes to the House under 12A.
Not ruling for Texas, also, essentially ends SCOTUS as we know it. In the back of their minds they know a Biden Admin will add 30 new SCOTUS justices, and their branch is done. They become a non-elected mini-congress and they make all the bad law that Congress can’t manage to pass.
As such, yes, they can screw this up, but they know what the impact will be if they do.
So there you go. It’s why this suit is so brilliant. The evidence matters here. In the appellate court, only reversible error is considered. The lower courts can play all the reindeer games they want because nobody is really looking, and they know SCOTUS is out there somewhere to backstop their idiocy (or not).
When all of this is over, if it ends well, there needs to be a sterilization of the entire system. It needs to be burned out thoroughly, like molten lead being poured down an anthill.
And we need to prepare something extra special spicy for the Chinese. This is/was a clear act of war.
If the SCOTUS screws this up, then the Constitution is done. The Rule of Law is either a true principle and violating it is not tolerated or accepted or we are a Lawless Country in which case we don’t need the SCOTUS.
These four states have violated a wide variety of election laws and Constitutional law. To say otherwise is delusional. If the SCOTUS lets these violations stands thereby rewarding the lawlessness, I would love to hear the logic from the SCOTUS on just how We The People could ever even remotely expect to see a truly fair and honest election again.
It is way past time for elections to become truly honest and fair. There have been places stealing elections for a long time and this country has pretended it does not exist. However elections stealing has gotten progressively worse and wider scale until we are now at the point where one party, the Commie-Rat party, is nothing more than an Organized Criminal Family.
As a country we are rapidly headed to civil war, dis-union, or an even worse fate of living under a totalitarian oligarchy.
Freedom is an abnormal state of human existence. America is exceptional because of freedom. If freedom is stamped out here, the entire world will enter a horrible dystopian age assistance by incredibly powerful technology where everyone is either an elite, a slave, or dead.
Thank goodness we have Christ, or this situation would truly cause one to despair.
And they ordered PA to separate all ballots received after the normal deadline. Do you think PA separated the ballots? Do you think SCOTUS thought PA would really separate the ballots? They knowingly let this happen and they are not going to do anything about it. It is a COLOR Revolution and the SCOTUS had a chance to throw a wrench in the gears, but did not.

There is only one thing that SCOTUS has to consider in this matter: whether or not we are a nation that lives by the rule of law. Period.
If the answer to that is, “Yes,” then they must listen to this case (which those on our side believe is a Constitutional slam dunk) and provide remedy for the disenfranchised voters in all states where election law violations occurred. That remedy must restore equal protection for all who voted legally, according to existing election laws governing the states where those voters reside.
By not listening to this case and determining that existing election laws were fairly superseded by judicial/executive fiat, then they are determining that, no, we are no longer a nation of laws, we are no longer governed by our Constitution and, perhaps with little self-awareness, that we no longer need to adhere to any future rulings by anyone sitting in judgment over legal matters, the rule of law being effectively discarded by such a judgment.

I wouldn’t think they would want to be among the first casualties. If it all gets hot there will be selective targets: the ones responsible.

Your point about a Biden Administration packing the court is something I've been thinking a lot about. If SCOTUS lets this theft of an election slide, it destroys them as a branch. It also destroys the legitimacy or our elections, the government, and the rule of law, and we're already on the ragged edge. That being said, I've learned to never underestimate the possibility of leaders to make shockingly bad decisions.
For me, while I do hope for the best, I'm definitely preparing for the worst.

Yes, they could have locked this situation down prior to the election but John Roberts, the smartest man in the room, sided with the leftists thinking he was so very clever to shaft Trump. I suppose he didn't expect that the dems would use the situation to cheat right out in the open the way they did though. As a result that fool put us in a very very perilous path that leads right to a major constitutional crisis.
If the Supreme Court refuses to declare these lawless, rogue states disqualified, the USA is officially over. From here forward, it will be “might makes right.” There will be a civil war and the victors will set new rules. There will be no pretense for laws or lawyers or judges having control over anything. The battlefield winners will make the rules.
This is a fight that has been coming a long time. The judicial cowards of the Supreme Court have been running away from the U.S. constitution for a LOOOOOONNNG time.

The fate of our REPUBLIC and our FREEDOMS protected by its Constitution are what is at stake with this case, and the Conservative justices on the Supreme Court must surely understand this.
Like it or not, they are standing in the breach, and it is a NOW or NEVER moment for them to fight for the preservation of our FREE REPUBLIC.

So you refer to ‘bad’ decisions - all decisions are made within the context of self-interest. It explains the failure of all governance. When we witness such ‘bad judgement’, people should automatically be going into investigation mode and seeking to depose them from whatever position they occupy at any level of government.

Five of the Supreme Court justices have shown they have spines and courage, by making it through the nomination process, while facing the lying slander of the Left/Corporate/Media/tech oligarchs.

And then there is that. I pray that God’s will is that the SCOTUS does their job.
General Lee prayed a very similar prayer when the North welshed on the deal they made with the southern states and drove them to war.
Lee was on the right side of the argument, and yet God’s will was that the North was going to be allowed to break their deal.
Now here we are.
Maybe this is the event. This is the trigger of the collapse of the US, leaving Israel alone in the world.
It makes sense to me. God protects Israel, not the US. The only way Israel is made to understand that eventually is that the US goes away, and Israel is alone to face its enemies.
Again, we tend to look at these things from our own worldview, when in the end we all serve God. We don’t have to like His plan, but we all need to follow it confident that in doing so we’re going to Heaven.
As such, whether the US continues or not doesn’t matter as much as the destination, Heaven.
