Democrats seem to want to decide for everyone what the word "long" means pertaining to "long established" precedent even though many decisions from SCOTUS haven't been decided for a long time, secondly they more often than not apply a thinly-veiled religious litmus test, and third they are often openly hostile towards Christianity/Catholicism, but not other religions, thus revealing their bigotry.
Democrats will have to recuse themselves.
They will say and/or do anything they think required to keep themselves in power.

Youre exactly right about precedent. I think the increasing reliance upon precedent over time is one of the greatest weaknesses of our legal system. It presumes that judges are superhumans who never make mistakes. Relying upon precedent to guide later decisions guarantees that errors or poor legal judgment will propagate and infect other cases, causing error to expand geometrically within the system.
I was thinking about Dred Scott when I posted this, but was focusing on recent decisions such as Obamacare which Democrats cannot claim as being a long-held decision, but yes, Fred Scott does significant damage to their argument.
That is what I would do. Tell them their attempt to build a new monolith are cancelled, the present one will stay, and in fact all vestiges of their attempt will be swept away.
