The child is the biological child of an American citizen. That would normally qualify it be a citizen.
Which does not confer infallibility.
Decision is wrong on it’s face.
The “parents” are not, the surrogate is not a U.S. Citizen.

Not the legal parents and thus end of story. My son was born in England of USA citizens. He is an American citizen. I took his English Birth Certificate down to the American Embassy in London and did the paperwork and he was given American Citizenship and passport. It was very simple. I also established his British Citizenship most legally. He has two passports. He can hold any position in the United States Government except president or vice president as he is also a citizen of the United Kingdom.
So the question remains for this, or any foreign born adoptee: When the kid comes of age and tries to locate his/her natural mother, succeeds, and decides to return to her, is he/she still a US Citizen?

According to some morons here, the child could run for President in 35 years.
We adopted overseas and had to get an Humanitarian Parole Visa to get the baby back into the states, then go through two years of interviews with INS at the time to get her citizenship. No quick ruling for us.
I think he could have dual nationality....but could be wrong. Many years ago when we did it LEGALLY....and paid through the nose with endless interviews.
I dont know who recommended this guy to Trump for nomination to a federal district judgeship but we need to investigate nominees backgrounds more vigorously. The fact that he got through the Judiciary Committee ON A UNANIMOUS VOICE VOTE and later confirmed by a vote of 92-0 tells me the DemocRATS were tickled pink with him.
So any American can send their sperm all over the world and create little US citizens?

But they adopted it, so it is now their child. Same would be true of a male/female marriage adopting someone else’s child.
