I suspect that he DID know the ‘dead guy’s’ mental capacity - or deficiency thereof.

What’s the crime?

How would you feel if a stranger goaded your 4 year old kid into jumping off a 6 foot wall? Wouldn't that be actionable? I think reckless endangerment sounds about right.

Sometimes jerkdom should warrant the Death Penalty.

Perhaps not. ‘Keonte’ is now beginning his new life as an object lesson for ignorant, cruel, overgrown-child ‘adults’.

I’d hate to be the lawyer forced to take this case.

Simple somersaults scared me to death. A backflip was out in the realm of total impossibility.

When I started lifting weights in high school, somersaults became easy.

About 10 years ago I was managing Christian based thrift store. An old homeless guy came in looking over our shoes. He clearly was not mentally “on top of things”.

I could clearly see that his old shoes needed to be replaced, at least by our standards. He located a brand new pair of sports sneakers that someone had donated to us. They fit well for him. But he was mulling over the price of $4. That seemed like a lot of money for him.

I “goaded” him into buying the new shoes. When you are in a situation like this it is important to check yourself to make sure you are not taking advantage. It certainly would have been criminal for me to suggest that he put on the shoes and try a few back flips.

My actions were validated the following week. The old guy came into the store when I happened to be there. He showed off his new shoes to me with a big smile on his face.

Goading can be used for good and goading can be used for bad.

I was going to say the same thing? Where is it a crime for the homeless to earn money they beg for? He was offer $6 for a service.

I think, as someone earlier suggested, that 'reckless endangerment' may apply. It's ensconced in Law; here's what wiki says about it:

A person commits the crime of reckless endangerment if the person recklessly engages in conduct which creates substantial jeopardy of severe corporeal trauma to another person. “Reckless” conduct is conduct that exhibits a culpable disregard of foreseeable consequences to others from the act or omission involved. The accused need not intentionally cause resulting harm. The ultimate question is whether, under all of the circumstances, the accused's demeanor was of that heedless nature that made it actually or imminently dangerous to the rights or safety of others.

And how exactly is anyone to know who is mentally ill, on the street?

When I was on the road circuit 40 years ago we used to pay/dare each other to do stupid tricks out of boredom. It could be anything from 8 chinups to 40 pushups to taking a second shower for no reason before the show. Everyone survived, though I did get hypothermia surfing in 52 degree water near Newport Beach somewhere.

Dunno - there’s a couple of folks here in town - I always try to remember to be extra nice to them.

There was one in the next town over. It was a shame to see.

Nonetheless, people were still jerks to him. Haven’t seen that guy in years. Frankly, I doubt that he’s still alive.

I try to remind myself of this verse, especially around those folks:

Hebrews 13:1-2 New King James Version

Concluding Moral Directions

1 Let brotherly love continue.
2 Do not forget to entertain strangers, for by so doing some have unwittingly entertained angels.

And these verses (it’s something I think of when I run across homeless people):

Luke 16:19-31
King James Version

19 There was a certain rich man, which was clothed in purple and fine linen, and fared sumptuously every day:

20 And there was a certain beggar named Lazarus, which was laid at his gate, full of sores,

21 And desiring to be fed with the crumbs which fell from the rich man’s table: moreover the dogs came and licked his sores.

22 And it came to pass, that the beggar died, and was carried by the angels into Abraham’s bosom: the rich man also died, and was buried;

23 And in hell he lift up his eyes, being in torments, and seeth Abraham afar off, and Lazarus in his bosom.

24 And he cried and said, Father Abraham, have mercy on me, and send Lazarus, that he may dip the tip of his finger in water, and cool my tongue; for I am tormented in this flame.

25 But Abraham said, Son, remember that thou in thy lifetime receivedst thy good things, and likewise Lazarus evil things: but now he is comforted, and thou art tormented.

26 And beside all this, between us and you there is a great gulf fixed: so that they which would pass from hence to you cannot; neither can they pass to us, that would come from thence.

27 Then he said, I pray thee therefore, father, that thou wouldest send him to my father’s house:

28 For I have five brethren; that he may testify unto them, lest they also come into this place of torment.

29 Abraham saith unto him, They have Moses and the prophets; let them hear them.

30 And he said, Nay, father Abraham: but if one went unto them from the dead, they will repent.

31 And he said unto him, If they hear not Moses and the prophets, neither will they be persuaded, though one rose from the dead.

If you’re well-acquainted with big city streets anywhere, it’s usually pretty easy to tell. And most streets or blocks have ‘regulars’. We have them even in the suburban neighborhoods, and everyone knows who they are.

(I can’t know, of course; but I can’t help but have the suspicion that Keonte had encountered this man before. I guess it will all come out in the wash, and a JURY will decide.)
