FARGO - Federal prosecutors have charged a 30-year-old man after video allegedly shows him smashing the windshield of an occupied police car during the May 30 riot in downtown Fargo.
Errick Steven Toa of Fargo appeared Wednesday, July 8, in federal court for a civil disorder charge that carries up to five years in prison.
Its possibly the first case in North Dakota history in which a protester has faced such a federal charge as a result of civil unrest or rioting, U.S. Attorney Drew Wrigley said Wednesday as he unveiled the criminal complaint against Toa during a press conference.
More people could face federal prosecution in connection with the riot, Wrigley said. Law enforcement continues to go through evidence to identify protesters who violated federal statutes, he said.
"They can wear masks. They can obstruct their identities only for so long," Wrigley said.

Probably not so with the judge and certainly not the appeals court.
Just one look and I already know it will be $50 and time served, fine suspended.
Isn’t there something the people who are standing around during the riot should be charged with, such as unlawful assembly, or aiding and abetting a riot? Surely it cannot be legal to give rioters cover by blocking LEO, etc.
Cases aren’t appealed because you don’t like the outcome; if there are no legal grounds for appeal (such as something wrong with the process of the original case, like concealed evidence) then there is no appeal granted.
I am quite aware of that. It is why so few appeals are traditionally granted.
But if you look at the number and types of federal appeals granted in the last 4 years, you can see legal grounds are EASILY drummed up. An objection sustained here, evidence excluded there, if a liberal does not like the outcome it is a very low bar.
You can be paroled for a federal crime, but to be eligible you have to serve 80% of your time. Ask former Louisiana governor Edwin Edwards. He was sentenced to 10 and served 8 and got a parole.
I expect he will be ‘released’ or the ‘charges will be dropped’. Local governments are protecting their antifa soldiers all across the country.

My pleasure. Federal time means you do nearly all of your sentence. There is good time credit, but no parole.
