Even if he could, I’m not sure I would want him to set a precedent like that for future Presidents to invoke.

He can use the NDPA to force open so many of their businesses that the lockdown won’t really matter.

He can light a fire under Bill Barr to start going after Governors who violate Constitutional rights.

If churches quit going along voluntarily and decide to fight for their First Amendment rights the Govs would all be on shaky ground.

I’d prefer he allow it to happen organically.

People are at the edge right now and We The People need to stand up for ourselves.

The Democrats are the ones keeping the country closed. People will revolt against their socialist overlords and it will show the world in November.

Right now it’s all on the Governors. It wouldn’t be a good move politically for Trump to generalize the reopening of the states.

Elected officials can declare emergencies in their jurisdictions, sheriff, mayor, governor. The president can declare a national emergency in accordance with the 1976 bill, , that means all 50 states. The congress can overrule, which they failed to do on the wall. so the answer is yes, he could. A state county or city cannot overrule the president in a national emergency, just as actor or county cannot overrule the governor. Today Gov Nuisance delayed all the beaches open except Orange county. Orange county supervisors have said, nothing they can do.

You can’t have national emergency response if the 50 states do their own thing. It’s up to the president if they do. I believe Trump wants them all to develop their own plan to get off lockdown.

Why not? I mean ex orders used to just apply to depts under the exe, not as law of the land but I see Cuomo issuing exe orders like they are LAW. COPS SEEM TO THINK THEY’RE LAW...

I have said this to my friends and family and I will say it here:

It should be We The People, and not the governors to re-open. Let it start small like it has been going around here: family gatherings, then friends... the beaches, churches...

Then we start calling businesses we need to be open. Make appointments if necessary. If/when things get desparate, don’t think local cops will be a problem. They can either get special service if they are willing to go along - or get denied service if they want to be the bad governor’s hand.

According to many, including Mark Levin, he can use the Commerce Clause:

The Commerce Clause describes an enumerated power listed in the United States Constitution. The clause states that the United States Congress shall have power "[t]o regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes." Courts and commentators have tended to discuss each of these three areas of commerce as a separate power granted to Congress.

It's the responsibility of the President to enforce the Constitution, of which the Commerce Clause is a part of. 8>)

He has a lot of latitude with businesses thar have Interstate Commerce dependencies. But his biggest hammer is the bailout money they are seeking. They will get something, but it should be tied to re-opening and be a fraction of what they are asking for.

I think he can but I don’t think that would be a good move politically. If the cases and deaths spike up then he gets all the blame, and it’s not like the MSM is going to give him credit for getting the economy going again anyway.

I think the numbers might creep up but not spike up. Most people think it’s worth the risk in order to get commerce going again.

Anybody old enough to remember rationing back in WWII? food stamps, etc among other things. Gasoline for autos, etc.

A rationing system after the attack on Pearl Harbor on 7 December

Sugar was the first consumer commodity rationed, with all sales ended on 27 April 1942 and resumed on 5 May with a ration of .5 pounds (0.23 kg) per person per week, half of normal consumption. Bakeries, ice cream makers, and other commercial users received rations of about 70% of normal usage.[15] Coffee was rationed nationally on 29 November 1942 to 1 pound (0.45 kg) every five weeks, about half of normal consumption, in part because of German U-boat attacks on shipping from Brazil.[16]

As of 1 March 1942, dog food could no longer be sold in tin cans, and manufacturers switched to dehydrated versions. As of 1 April 1942, anyone wishing to purchase a new toothpaste tube, then made from metal, had to turn in an empty one.[3]:129–130 By June 1942 companies also stopped manufacturing metal office furniture, radios, television sets, phonographs, refrigerators, vacuum cleaners, washing machines, and sewing machines for civilians.[3]:118,124,126–127

By the end of 1942, ration coupons were used for nine other items:[3]:138 typewriters, gasoline, bicycles, shoes, rubber footwear, silk, nylon, fuel oil, and stoves. Meat, lard, shortening and food oils, cheese, butter, margarine, processed foods (canned, bottled, and frozen), dried fruits, canned milk, firewood and coal, jams, jellies, and fruit butter were rationed by November 1943.[17] Many retailers welcomed rationing because they were already experiencing shortages of many items due to rumors and panics, such as flashlights and batteries after Pearl Harbor.[3]:133
