Can Trump Overrule the Governors and Open Up the Country with an Executive Order? (Vanity)

Blue state resident here (Virginia). This lockdown was supposed to be only 15 days and then it was extended to 30. But Democrat governors across the country are seemingly extending these lockdowns indefinitely. This is no longer about protecting the health of citizens. Millions of people have lost their jobs and their businesses.

It seems the Democrat governors will extend these lockdowns for months. Millions of people want to work and want to get out of their homes but are afraid of being arrested.

Can Trump overrule these governors with an EO? Seems crazy that these governors could just close their states forever because they feel like it.

Anybody old enough to remember rationing back in WWII? food stamps, etc among other things. Gasoline for autos, etc.

A rationing system after the attack on Pearl Harbor on 7 December

Sugar was the first consumer commodity rationed, with all sales ended on 27 April 1942 and resumed on 5 May with a ration of .5 pounds (0.23 kg) per person per week, half of normal consumption. Bakeries, ice cream makers, and other commercial users received rations of about 70% of normal usage.[15] Coffee was rationed nationally on 29 November 1942 to 1 pound (0.45 kg) every five weeks, about half of normal consumption, in part because of German U-boat attacks on shipping from Brazil.[16]

As of 1 March 1942, dog food could no longer be sold in tin cans, and manufacturers switched to dehydrated versions. As of 1 April 1942, anyone wishing to purchase a new toothpaste tube, then made from metal, had to turn in an empty one.[3]:129–130 By June 1942 companies also stopped manufacturing metal office furniture, radios, television sets, phonographs, refrigerators, vacuum cleaners, washing machines, and sewing machines for civilians.[3]:118,124,126–127

By the end of 1942, ration coupons were used for nine other items:[3]:138 typewriters, gasoline, bicycles, shoes, rubber footwear, silk, nylon, fuel oil, and stoves. Meat, lard, shortening and food oils, cheese, butter, margarine, processed foods (canned, bottled, and frozen), dried fruits, canned milk, firewood and coal, jams, jellies, and fruit butter were rationed by November 1943.[17] Many retailers welcomed rationing because they were already experiencing shortages of many items due to rumors and panics, such as flashlights and batteries after Pearl Harbor.[3]:133

He better do it quickly. Was at the eye doctor today and a young woman was talking about he disruption the meat supply affecting her business (preparation of specialty meats) and that they were about to be cut off by suppliers. The news is not reporting the total gravity of this because they know the Democrats and the media itself will be blamed.

I don’t see it, so my 2 cents:

Trump started this with a declaration of a National Emergency. This kicked some things into motion Federally and enabled him to set Federal guidelines for things like Social Distancing that States had to be in compliance with if they wanted the Federal Emergency money. At least, this is my understanding.

Based on this, I was expecting that Trump may have to declare an end to the National Emergency before States would start ignoring his guidelines. But Federal money may not be all that States are considering. It’s hard to believe that a State would chose to stay paralyzed once the Federal cover is gone.

Absolutely correctamundo. For all we know, these Rat governors are making the extensions, etc. in an effort to goad POTUS into an EO so they and their MSM accolytes can raise a ruckus over it. Nah! Let the Rat basteds face their constituents.

I mostly agree and my aunt was part of the statistics (died 4/23) BTW this is not really a pandemic but an asymmetric warfare event. Based on that I think we need to take some strong decontamination actions using military grade equipment and agents in the areas where the virus is most prevalent. The number of deaths have gone up and the death rate has been steady.

We are in Phase 3 clinical testing of HCQ/Z-pack/Zinc which is the FDA approval phase for use which should start to arrest it.

Excellent work has been done by DoughtyOne daily which is what I monitor too:

I didn’t say he should do it. I said he has the power. The EPA is about emergencies pandemics are health and safety emergency

emergency powers of the president encompass a wide range of emergencies as they dup to the governors.

I like him leaving it to the states even if he has the power to do other wise.

governor nuisance by closing only orange county beaches will make the SD and LA county beaches more crowded. The wisdom of liberal government. The sheriff in OC says people kept their distance and the beaches should be open.

Not by EO. Under the New Deal interpretations of the commerce clause and the Supreme Court decision on the Civil Rights Act, congress can pass a law requiring opening up everything. Anything that affects interstate commerce, even indirectly, can be regulated by Congress under the New Deal commerce clause cases.

I don’t see how Trump has that power by EO.

(They are horrible cases. But that’s the law).

“There was only 1 case back in the 40’s I think where the gov argued they had a right to force certain thing within the states because not doing so was harming interstate commerce.”

The case that said the Civil Rights Act was constitutional in the 1960’s was a commerce clause case that held a business that was local and entirely in-state could be regulated by Congress under the commerce clause.

He can rescind approval of their Emergency Powers act and them they will not have the authority to make these really harsh lockdown stuff. But then that will become an election issue with all of the fear and hype the demorats can muster.

That would be a politically stupid move. Let the govs make the decisions, they know what is best for their state and if they screw up, it is their fault.

I’m not sure he can, but it would be fun to see the governors try to re-close things after the president opens them. That would be a wonderful setup for 2020.
