Louisiana sues California over alligator ban

In a lawsuit filed Thursday, Louisiana said the economy surrounding alligators has played a key role in bringing back the American alligator population and is an important factor in protecting wetlands and other species besides alligators that depend on the wetlands.

“California has nevertheless attempted to destroy the market for American alligator products notwithstanding the fact that no such alligators live in California," the lawsuit says.

According to The Times-Picayune/the New Orleans Advocate, California banned alligator skins and meats in the 1970s but repeatedly issued exceptions that allowed sales. The newspaper reports that the most recent exemption expires on Jan. 1 of next year, and this time California's legislature did not pass another exemption. The newspaper reports the alligator ban was backed by a coalition of animal rights and environmental groups.

Isn’t there language in the Constitution that forbids States from erecting barriers to trade with other States?

Reports on species migration indicate alligators came to America thru Mexico. So if alligators could vote in California they would outnumber Asians at this point.

It is the Commerce Clause.

For quite a few years it has been called the "Dormant" Commerce Clause, because the Supreme Court has refused to uphold its original meaning.

Yes, there is the Commerce Clause:

3: [The Congress shall have Power] To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;

Which also means the States do not have the power to regulate commerce with other States.

So for example, Michigan cannot prohibit the import of cars from California while allowing sales of cars built in Michigan.

But it's generally interpreted to allow a State to entirely prohibit sales of something, as long as the prohibition doesn't discriminate against things made out of State.

That's important, for example, in the era of marijuana legalization.

Just ship the gators to San Francisco and other CA places with homeless populations. The gators can then have a feast and clean up the streets at the same time.

Interesting. When one state directly sues another (which is very rare), the case is tried directly by the Supreme Court who is judge and jury.

Fried alligator is quite the delicacy— whenever we visit New Orleans we order it at Coop’s Place, a wonderful cajun dive on Decatur St., near the French Market.

It’s delicious! I highly recommend it, but the tastiness of the meat depends on the ‘gator’s own diet.

So, no, I wouldn’t recommend feeding the homeless to alligators.
