If she hadn't lied, and just said -- I was too shell-shocked, I stared at the wall of the apartment for 20 min; MAYBE I could believe that.

But in that case, I'd have thrown her ass out of the police dept. in microseconds: you can't trust a cop with a gun if they cannot handle the aftermath.

The gun is a last resort to protect, not a magic bang-stick to get you out of trouble (and then everything fades to a commercial and life goes on like nothing happened).

Never said she was Miss Congeniality.

All I’m saying is that she did not go into Mr. Jean’s apartment with the intent to murder Mr. Jean, because Mr. Jean was eating ice cream in his own apartment!

She should have been convicted of manslaughter, in my opinion.

First, stop assuming I’m a “sir”.

Your 1st “point” is not a point at all really. It DOES make a difference if it was an ACCIDENT vs. DELIBERATE. My God, when are we going to start accepting that accidents happen and stop just suing everyone and wanting their heads?

Think about the stupid bus driver who killed a bunch of kids because she left the bus on the train tracks (which is not smart no matter the exact situation). Are you saying she should be treated as a “murderer” just because she did, indeed, do something stupid? Negligent, yes, but deliberately criminal?

In your words, it doesn’t matter that it was purely an accident (100% a mistake), the person having the accident should be run through the wringer.

Conservatives talk a big deal about “emotions”, but sounds to me that we’re letting emotions run away with whether someone should be treated as a criminal or not.

Leave the angry emotion for the real criminals, please.

As was pointed out by a previous poster:

Texas Penal Code § 19.01. Types of Criminal Homicide

(a) A person commits criminal homicide if he intentionally, knowingly, recklessly, or with criminal negligence causes the death of an individual.

(b) Criminal homicide is murder, capital murder, manslaughter, or criminally negligent homicide.

She's guilty. I think committing a home invasion is criminal negligence for section a and the act of shooting a guy for the crime of eating ice cream on his couch clearly meets the criminally negligent homicide statute.

Yep, she shot a guy sitting on his own couch, watching his own TV and eating a bowl of ice cream. Even though it was clear from her 911 call that the only “assistance” she offered him was to say “hang on buddy”, she testified that she performed first aid and CPR, only for the prosecution to show that she had not a drop of blood on her or her uniform (she lied). She also said she “forgot” about the first aid supplies in her backpack. Officers who responded to her 911 call found the victim still alive and attempted to perform CPR themselves.

Victim deserved justice, and he would have gotten it with a manslaughter conviction as well. The murder charge was an emotional conviction, in my opinion. You don’t have to like it or agree with it.

I agree with it.

What sort of first aid is useful to a man with a bullet hole in the center of his chest? If the bullet went into his heart or his artery, he's dead dead, and pushing on his chest would just make a big bloody mess while helping him bleed out faster.

What could she have done to help him? Expressing concern doesn't actually do anything medically useful. If he was shot in the heart or the arteries leading from it, I doubt the finest medial surgeons in a fully staffed operating room could have done much for him.

Maybe an operating room and surgeons could have saved him if the bullet just hit an artery, but if it hit his heart, they can't fix that quickly enough to do him any good.

Scrawny 5'1" woman cop? What's she gonna do?

You showed the definition of criminal homicide with sections (a) and (b), but you didn’t break it down to what constitutes and what is REQUIRED for each of those listed charges (i.e., murder, capital murder, manslaughter or criminally negligent homicide).

Since according to everyone the Texas Penal Code is so easy to understand, let’s look at the following:

Sec. 19.02. MURDER. (b) A person commits an offense if he: (1) intentionally or knowingly causes the death of an individual;

So, according to everyone who posts the Texas Penal code, no matter WHAT, if someone shoots someone else and they die, that person has committed the offense of Murder 1!

Police officer in the line of duty, defending yourself from an attacker, no matter WHAT, they have committed Murder 1! SO WE SHOULD LOCK THEM THE HELL UP!

This sort of deliberately misstating intentions is not greatly different from Liberals claiming Bush invaded Iraq to trade blood for oil.

No, she did not shoot him for the "crime of eating ice cream on his couch." She shot him because she mistakenly thought he was an intruder into *HER* apartment, which is a reason most people would think was sufficient to shoot someone.

She was wrong about where she was and what he was, but she most certainly did not shoot him for reasons of ice cream or couch sitting.
