In Imbler, the Supreme Court held that prosecutors are generally entitled to absolute immunity from civil liability under the federal civil rights statute, 42 U.S.C. § 1983, for actions, taken in their role as prosecutors, that may have violated the rights of a criminal defendant. Absolute immunity is exactly what it sounds likea blanket and unconditional grant of protection from civil liability. A related doctrine, qualified immunity, also protects government officials from liability, but as the Supreme Court explained in Harlow v. Fitzgerald, only if their conduct does not violate clearly established statutory or constitutional rights . . . . Put simply, qualified immunity protects government officials who abide by the rules (although the law defines those rules very narrowly). Absolute immunity protects them from civil liability even when they break the rules.
NIKK..ignorant of law...but Peabody after reading this...it leads me to believe if the prosecutors/all involved/ didn’t follow the rules ..perhaps broke laws in the Florida case/ they can go back to court?

That’s what Judge Jeanine (and others) is saying....how very unusual for these co-conspirators (MaxieGal, Slick, etc.) to be given total, forever immunity.
You’re correct....these girls (underage, at the time) certainly did NOT get true justice.
It will be interesting to see how/where this now goes. The buck is (currently) stopping w/AG Barr, if I am reading right. Then, maybe, ultimately w/Supremes?? Not sure.

.....Tuesdays push is in response to a February court ruling that Epsteins nonprosecution agreement violated the federal Crime Victims Rights Act, because underage girls assaulted by Epstein in Palm Beach werent told about the deal in advance.
In recent weeks, a clamor over Epsteins deal led to the July 12 resignation of Labor Secretary Alexander Acosta, the former U.S. attorney who directed Epsteins immunity from federal crimes a dozen years ago.
U.S. District Judge Kenneth Marra is expected to rule soon on what steps should be taken to rectify the violation all these years later.
Some of Epsteins victims, while expressing gratitude for the new charges in New York, say they also want Epstein to be held accountable by federal authorities for offenses that happened in his Palm Beach estate from 1999 to 2007. He abused dozens of minor girls, some as young as 14, during those years, court records show.
The victims are asking Marra to rescind the immunity for Epstein and his unnamed co-conspirators, to clear the way for new charges.
The Government and Epstein reached a secret nonprosecution agreement and then concealed that agreement until it was firmly in placeand the victims lost any opportunity to object, wrote victims attorney Bradley Edwards.
This secret justice for Epstein and his co-conspirators has led to a national outcry about unfairness and unequal treatment of the wealthy and powerful in the criminal justice system.
Government prosecutors want the agreement kept in place while offering victims opportunities to air their concerns and stories. And Epstein opposes any move to reopen the 2007 agreement....

Judge Marra decided in February, that the non prosecution agreement, negotiated between the US Attorney’s Office in Miami and Epstein’s attorneys in secret, violated the Crime Victim Rights Act. The next step, is to decide what the victims should receive for the violation of their rights.
“Epsteins death could help convince Judge Marra to void the entire non prosecution agreement because you no longer have issues of double jeopardy because Epstein is not around anymore, plus Epstein had paid restitution to some victims but thats not a concern anymore because Epstein is gone,” said Palm Beach County State Attorney Dave Aronberg.
