If he lived in Nevada and still had an address there, then the FFL probably cant be liable. If the FFL knew he was a Cali resident, then the FFL will probably lose his license at best for selling him a rifle that was not on the Cali approved list.

Santino William Legan, a Bay Area native who lived in Walker Lake, Nev., legally bought the WASR-10 semiautomatic rifle with a detachable magazine at Big Mikes Gun and Ammo in Fallon (Churchill County) on July 9, less than three weeks before Sunday’s shooting, the official said.

You seem to be correct that the shooter was a resident of Nevada at the time of the purchase.

You need NV state issued ID to purchase in NV. Apparently, the shooter moved to NV after graduating from Gilroy HS. He was a legal resident of NV, and bought the gun there.

Isn’t it funny how some stories get way more play than others?

By which I mean a story where three people died via “an AK-47-style assault rifle” will usually get more coverage than five deaths with a revolver.

Almost like the media has an agenda.

The gun shop did no wrong.
If it was a hardware store and they sold the axe used in an axe murder, they aren’t to blame.
A gun is just a tool. Blame the user not the dealer.

Agreed. He, along with others such as Lanza, Cruz, and other mass shooters, could have used a single shot rifle or shotgun or perhaps even a knife and achieved the same sort of death toll results given that these incidents took place where guns are banned and whatever the police response time was.

As long as everything was done legally there's *no* reason to apologize. In fact that might even be true if everything *wasn't* done "legally".

It's not the shop's fault...it's not the firearms manufacturer's fault...it's the SHOOTER'S fault.

Even if it was a legal Nevada purchase, it was illegal to import/bring an assault rifle into California.

Irrelevant. California law requires the TRANSFER take place in Ca with full compliance of waiting periods, and federal law requires compliance with the state laws both in the selling state and the state of residence.

Incorrect. FEDERAL law says the laws of BOTH states must be complied with or the sale is illegal under federal law.

If the guy was a Nevada resident and told the shop he lived in Nevada, then the store is off the hook. If he said he was a California resident, then the shop has to comply with California law or be in violation of federal law.

As I read it. Not a lawyer so take it with a big steaming cup of FWIW.

Watch the accompanying video. FBI Agent Craig Flair states around the 1:02 mark police officers and FBI AGENTS were on scene when when the shooting occurred.

Can someone explain why the FBI was present at the Garlic festival prior to the shooting unless they were waiting for him and knew he was coming?

I never hear anyone apologize for the gang bangers who kill people in Chicago with guns..the gun owner has nothing to apologize for, the perp bought the gun, picked it up in person, I assume he passed a background check with flying colors at 19 years old did he have a criminal record otherwise there is nothing this guy could have done
