SAN FRANCISCO (CBS SF) The owner of the Nevada gun shop that sold an assault rife to the Gilroy Garlic Festival shooting gunman apologized on Monday, saying he hopes for the gunman to rot in hell.
In a Facebook post, Mike, the owner of Big Mikes Guns and Ammo in Fallon, Nevada, said that Sundays mass shooting goes against everything he believes in.
I have always said we will sell to good people and have done everything we can to make sure this happens. We obey the laws, we are a small home business, we sell to people who we think are upstanding citizens to promote safe sport shooting. I pray to God for all the families, Mike said in the post.
Gilroy Police Chief Scot Smithee said Monday that the shooter legally purchased an AK-47-type assault rifle in Nevada on July 9th.
The Big Mikes Guns and Ammo owner said the gunman, 19-year-old Santino William Legan of Gilroy, didnt show any reasons for concern, even saying he was acting happy when he saw him after ordering the gun online.
The shooter in CA, I hope you rot in hell. We pray for the victims. My heart hurts for all of them, Mike said in another post.
Armed with the rifle, Legan evaded security at Christmas Hill Park by using some sort of tool to cut through a fence near a creek that borders a parking area, police said.
Officers on the scene shot and killed Legan within one minute of the shooting.
Smithee said witnesses told authorities at least one other person may have been involved in the shooting, but there was no confirmation of that or the role he or she might have played. He said a manhunt was underway for the possible accomplice.

Its state law, not federal. So maybe Arizona doesn’t care, but I think Nevada requires you show residency in the state.

In the article, the police chief says it was legally purchased. It was an SKS so the police chief is incorrect when he says it was an AK-47 style assault weapon. Key take-away .. it was legally purchased.
Gaijin, we do not know if the AK was California compliant, or if it met the California definition of an illegal "assault weapon."
But as others have pointed out, (and as I should have remembered,) California forbids its residents from purchasing any firearm out of state, regardless of federal law.
So assuming the AK was a standard configuration, the Nevada gun shop shouldn't have made the sale for two reasons: Not a California compliant firearm, and an out of state sale to a California resident.
Nevada gun shop apologizes... is false and bait. Nothing in the CBS article demonstrates the claim in the headline and first paragraph that the gun shop owner apologized.

Im looking at post 13 and it does seem that yes Cali prohibits a sale if on a ban list but theres nothing that prohibits some states to make the sale.

Federal law says you can buy a long gun from an adjacent state as long as the sale is legal in your home state, but a court ruling expanded it to any state, with the same home state legality caveat.
As others have already pointed out, California state law forbids its residents from purchasing firearms outside of California, which is probably why the Arizona gun shop refused you.
Police chief seems to be wrong. Federal law says the sale has to be legal in BOTH states, and it was illegal in California. Thus federal law says it was illegal. Not a lawyer but it seems pretty clear cut.
Nothing about this sounds good, and I think this dealer should have remained silent. I am having trouble wrapping my head around a CA resident going to buy a gun in NV online. Normal procedure would be to have it shipped to an FFL near you.
That would be another matter entirely if he had a Nevada ID and address for the form 4473.
Then the sale probably would have been legal.

you can purchase online and pick up at the retail location or have it shipped to an FFL closer to you and then pick it up from them.
