Thread: Was the Global Hawk in Iranian Airspace (as the Iranians claim)?
9. Lets clear up the confusion. What does international law say about the Strait of Hormuz? The Strait is categorized as a “Straits Used for International Navigation” (commonly abbreviated International Strait) as the term is used in UN Convention for the Law of the Sea (UNCLOS)
*******************
10. The legal regime that applies to navigation through International Straits is called Transit Passage. In Transit Passage, aircraft may also pass freely through the strait (contrary to Innocent Passage)
*******************
11. Lawful Transit Passage may not be interfered with or stopped by a coastal state bordering the strait. All these principles were firmly embedded in customary law prior to being codified in UNCLOS.
******************
12. Iran’s strait baseline claims were indeed unlawful, but they really don’t come into play here as the Strait of Hormuz is only 21 miles wide at its narrowest point.
*****************
13. Both Iran and Oman have claimed 12-mile territorial seas thus completely encompassing the Strait through part of its passage into and out of the Gulf. The following is an excerpt from UNCLOS dealing with some of these issues:
******************
14. PART III - STRAITS USED FOR INTERNATIONAL NAVIGATION
Article37
Scope of this section
This section applies to straits which are used for international navigation between one part of the high seas or an exclusive economic zone and another part of the high seas or an exclusive economic zone.
******************
15. Article 38
Right of transit passage
******************
15A. In straits referred to in article 37, all ships and aircraft enjoy the right of transit passage, which shall not be impeded; except that, if the strait is formed by an island of a State bordering the strait and its mainland, transit passage shall not apply if there exists seaward of the island a route....
****************
15C. ... through the high seas or through an exclusive economic zone of similar convenience with respect to navigational and hydrographical characteristics.
**************
16. Transit passage means the exercise in accordance with this Part of the freedom of navigation and overflight solely for the purpose of continuous and expeditious transit of the strait between one part of the high seas or an exclusive economic zone and another part of the high seas or an exclusive economic zone.
*************
17. However, the requirement of continuous and expeditious transit does not preclude passage through the strait for the purpose of entering, leaving or returning from a State bordering the strait, subject to the conditions of entry to that State.
************
18. Any activity which is not an exercise of the right of transit passage through a strait remains subject to the other applicable provisions of this Convention.
***********
19. Article 39
Duties of ships and aircraft during transit passage
****************
19A. Ships and aircraft, while exercising the right of transit passage, shall:
- proceed without delay through or over the strait; refrain from any threat or use of force against the sovereignty, territorial integrity or political independence of States bordering the strait, or in any other manner in violation of the principles of international law embodied in the Charter of the UN
*****************
19A. (cont’d)
- refrain from any activities other than those incident to their normal modes of continuous and expeditious transit unless rendered necessary by force majeure or by distress;
- comply with other relevant provisions of this Part.
****************
19B. Ships in transit passage shall:
- comply with generally accepted international regulations, procedures and practices for safety at sea, including the International Regulations for Preventing Collisions at Sea;
****************
19B. (cont’d)
- comply with generally accepted international regulations, procedures and practices for the prevention, reduction and control of pollution from ships.
*************
19C. Aircraft in transit passage shall:
- observe the Rules of the Air established by the Int’l Civil Aviation Org as they apply to civil aircraft; state aircraft will normally comply with such safety measures and will at all times operate with due regard for the safety of nav; at all times monitor the radio frequency assigned by the competent internationally designated air traffic control authority or the appropriate international distress radio frequency. of these issues.
**************
20. So whats the bottom line? That Global Hawk was under transit passage rules of UNCLOS and had a right to transit the strait according to its flight plan.
************
21. Additionally, Iran claims a 12-mile limit for its territorial limits, yet the RQ-4 was shot down at 21 miles, which is clearly outside Iranian territorial airspace. In short, the IRGC violated international law when it shot down the Global Hawk. ///The end.

Was the Japanese tanker in Iranian waters last week? Item also used an old video footage yesterday to show the uav being shot down.

No. International strait/waters.
*************
David
Exactly. Put the US flag on every ally tanker in the area.
******************
Empowered Rights
As a nation, we need to conduct ourselves as we expect of other nations. Imagine if Iranian military ships & drones were off our coasts.
***************
Stu Cvrk
Wrong. If/when Iranian ships/aircraft are in international waters (or an international strait), they have the right of free passage. Just as ours do in the SOH. Period.
******************
Denise Snively
See @ClimateAudit He states the drone was in Iran’s ADIZ. He’s trustworthy so????
****************
Stu Cvrk
An ADIZ is not recognized under international law. I say again, the Global Hawk was shot down 21 miles from Iran (which claims a 12-mile territorial limit).
*******************
Michelle Sass
Stu, Excellent info! I was going to ask you about the rules of territorial seas regarding the 12 and 24 nautical miles limit. Thanks!

Rep. @mattgaetz gets the MAGA Agenda:
“
@POTUS is not eager to lurch into another Middle Eastern regime change, endless, unfocused, unconstitutional war.
@POTUS ran as a very different kind of Republican, somebody who wanted to end wars, not start them.”
