Speaker Ryan: You cannot end birthright citizenship with an executive order
House Speaker Paul Ryan on Tuesday broke with President Donald Trump on whether an executive order could deny a constitutional guarantee of citizenship to babies born in the U.S. to noncitizen parents.
But despite Ryan's stern rebuttal to the president, the idea of limiting birthright citizenship still has significant cache among congressional Republicans, even if they aren't quite sure how to undo a constitutional guarantee stemming from the 14th Amendment.
Trump told Axios in an interview released Tuesday that the White House counsel had advised him that there was legal standing to terminate birthright citizenship, and Vice President Mike Pence confirmed that the administration was looking into using executive action as well.

As a conservative?
Paul Ryan..... Just freaking go away. Nobody except Romney wants you around.
STFUPR.
That is where you are wrong kiddo!
Even Zero said you can’t start DACA by executive order either, but here we are.
Ryan is seeing his relevancy slipping away. Poor guy.
Trump OWNS these people... 4D chess to get the ball rolling.
Awww shed up!
Who sez?
Isn’t he going? Don’t let the door hit you ...
Lamest of ducks.
Trump is brilliant. He knows full well that a federal circuit judge in Hawaii and or San Francisco will issue an order blocking his executive order. Probably the ninth circuit in Frisco.
This case will be fast tracked to the Supreme Court and put to bed with a good decision by our two new conservative judges. The right to citizenship will then be defined constitutionally.
I am not tired of winning!
Okay Mr. Plain Text, answer this for me: why is the clause "and subject to the jurisdiction thereof" included in the 14th Amendment? I mean, if the 14th Amendment conveyed citizenship to anyone simply born here, that clause would not be necessary, would it?
Trump’s answer:
“Watch me.”
When this goes to court, the order staying the action should be ignored.
If I go to a court for a speeding ticket, speed enforcement is not suspended until the case is resolved.
I think the no-children-of-illegal-immigrants clause of the 14th Amendment is right before the gay marriage clause and just after the abortion rights clause.
That’s Ryan’s personal opinion and he may even hold it honestly. OTOH, I am sure that Trump consulted with Justice Department lawyers and was told he is on firm constitutional ground.
It’s not really going to matter much in the short term. Liberal lawyers are going to be charging into the courts to file injunctions against the order before the ink is dry, and I’m positive they will get one, which means it’s going to have to go all the way up to the Supreme Court before any real decision is made, and that’s going to take a couple years, at least.
So, what is Trump really trying to accomplish here? Thoughts?
This will end up in the Supreme Court, but the correct reading of the Constitution will finally be enforced. Lindsey Graham’s bill could do it if Trump’s executive order does not.
Good riddance you jealous, small, inconsequential man. And please, STAY AWAY RYAN!
I see it! It was hidden in the dark fringe of the penumbra right next to "abortion." I'll be a son of a gun!
