NBC Reluctant To Give Megyn Kelly Big Payout As Part Of Exit After Missteps

Megyn Kelly is off the air and heading toward the door at NBC, but it looks like any exit won’t be as smooth as the former Fox News Channel host may have anticipated. Over the weekend and today, increasingly intractable NBC News boss Andy Lack has made it clear in talks with Kelly’s reps that a hefty payout for the rest of her $69 million contract is a non-starter, well-positioned sources tell Deadline.

You can pay a lot of lawyers to litigate for many years over $69 million. If her ratings had been good they would not have been so eager to fire her.

My guess is that she will get most or all of her contracted payout. It is just a question of whether NBC wants a very public lawsuit dragging on for years or to quickly and quietly settle.

I disagree. For the balance of a $69 million contract it would be well worth the attorney’s fees to litigate. Contract law is not very complicated. It was a guaranteed contract and they breached. Pay up.

Alternatively, they could let her finish out the rest of the contract. It’s very unlikely she will be able to mitigate her losses by signing another huge contract with another network in the next year and a half.

Her lawyers will have a field day. They could get double the buyout because of emotional distress. It was a set up. If you fire someone for making a comment about “blackface” halloweeners, then you obviously were looking to fire her..the bad news is that she will end up owning a big chunk of that lousy network. I would consider that a ‘pyrrhic victory’.

Hey, a deal’s a deal. I thought they hired her to stick it to conservatives, not to make money. If they no longer think it was worth it, that’s their problem.

NBC using “racism” as the excuse for their own bad decision in hiring her. Gutless Andy won’t take the heat for firingvher outright. You might not like Kelly but you can see this is just another example of executive cowardice.

Pigs are flying AND hell has frozen over....I'm defending Megyn Kelly! Rather than defend or establish guilt of accused sexual predators, they were given huge payouts. Since the GWB depression, upper echelon execs have been given huge payouts for destroying companies. I would've been willing to destroy them for a small fraction of their take. Venture capitalists (such as Mitt Romney) make huge profits for trashing companies, causing hardship for employees and stock holders.

NBC made a stupid deal with Megyn Kelly. They had to know she was too provocative for their mindless and agenda-driven news reporting. NBC should shut up and put up.

And three cheers to Megyn Kelly for taking a stupid deal that is a win/win for her!

Haven’t seen the contract outright, but everything I’ve heard is that it was pretty airtight and “non-breakable”.

I seriously doubt there is anything in there that allows them to break the contract on a whim, which is all this is.

No longer a fan of Me-Again since her shenanigans at the first Republican debate (which in all likelihood is how she ultimately wound up getting such an unbelievable deal), but I hope NBC takes it up the behind on this one and needs to pay her the full remaining $$s.

I don’t care much for her at all but I hope she sues them into oblivion for firing her over something THIS STUPID.

During a discussion of changing morals, and how it affects Halloween costumes, she says that a ‘blackface’ costume would have been acceptable 30 years ago, but not now.

That is not only factually correct, but illustrates her point. Just SAYING the word blackface is now racist????? And you can be fired for it?

How the hell are you going to discuss history if you are not allowed to use actual words...?

Appropriately they are running the movie Disclosure on one of the paid channels this month!

Not being 100% familiar with her contract but would seem to me unless she did something immoral, something that defamed the network, or violated the law while on the air, my guess is they are on the hook for the full amount. Furthermore, in a contract enforcement action, my guess is also she could sue for her attorney’s costs. At 69 mil, they get off cheaply. They should have taken a page out of sports management: never sign someone who is a clubhouse problem. Eventually it comes back to bite you.

NBC snagged her because she attacked Trump in the 2016 primaries. They did it to pander to their Trump-hating base. Now it should cost them the full contract amount plus her shyster bills. The Trump dog bites while it growls “covfefe”.

I agree.

I confess that I didn't follow this very closely (I have no TV) but as I understand it, Kelly didn't exactly "make a comment". I think she asked a question. So NBC is in the position of firing a journalist because the journalist asked a probing question that made some people uncomfortable. Is that a fireable offense?

Just hand her $69M.

I am no fan of Kelly’s, but contract law is easily enforced with a good attorney.

Whether I like her or not, I think as a self promoter she is smart and the contract is probably written for her protection.

In short, when you sign a contract, you had better be sure that it is really what you want because contracts are enforceable as they are written.

NBC is the worst of the two so I hope she wins in court.
