A man freed from prison in May after a judge vacated his 1991 rape conviction in Westmoreland County was arrested Thursday on charges of sexually assaulting a 7-year-old child at his home in McKees Rocks.
John Kunco, 53, previously of Harrison, was arraigned Friday on charges of aggravated indecent assault, unlawful contact with a minor, corruption, endangering the welfare of children and indecent assault.
Court documents list the date of the offenses as May 23, the day Kunco was released from prison after serving nearly 28 years of a 45- to 90-year sentence in an unrelated rape case.
Last week, officials received a Childline report from a 7-year-old girl who said she had been sexually abused by Kunco, a criminal complaint shows.
The child told officials she recalled lying beside Kunco on a futon, falling asleep and waking to Kunco sexually assaulting her. She said she was 6 when it happened.
Court records indicate that Kunco was able to post 10 percent of the $25,000 bail set in the new Allegheny County case Friday but Westmoreland County District Attorney John Peck said he believes that Kunco is in jail awaiting a mental health evaluation and is not expected to be released before Monday.
On May 23, Kunco was released from prison on a $10,000 unsecured bond after a judge vacated his 1991 rape conviction and gave prosecutors the option of a retrial.

“Childline” is the Commonwealth of Pennsylvania’s child abuse reporting system.
Do I read correctly that this individual stands accused of attempted child rape committed the very same day that he was released from prison??? That he is accused of having gotten out of prison, and then immediately attempted to rape a little girl?
So.... a scumbag that was not guilty of the crime for which he was convicted????
Wanna see my shocked face?
“DNA testing last year of a blanket believed to have been present during the rape ...”
Believed to have been present, it doesn’t sound as if they are sure about that. Besides, a 55 year old woman may have had sex with her boyfriend, or husband. Just because the perp’s DNA wasn’t on a blanket “believed to have been present” doesn’t mean he didn’t commit the crime. Sounds as if the Innocence Project may have gotten this guy out based on faulty “evidence”. If that is the case, someone at the Innocence Project should be charged with this child’s sexual abuse along with the perp.
Well, you can count me as one who is pretty confused also. To give the age of a child when it supposedly happened surely must mean it didn’t happen the day he got out of prison. DOES IT? But again - over and over and over, we are supposed to waste our precious brain cells trying to make sense of most all stories today.
“”The child told officials she recalled lying beside Kunco on a futon, falling asleep and waking to Kunco sexually assaulting her. She said she was 6 when it happened. “”
Let’s not forget who runs the Innocence Project. They managed to declare and were believed that OJ’s DNA wasn’t OJ’s DNA - it had been tampered with!!!!! Scheck and Newfeld built their reputations and company on that....When DNA results suit their purposes, it’s reliable. When it doesn’t suit their purpose, it’s not reliable.
