I don't know how to do

On April 1, my car was hit at the roadside , the driver of the accident take full responsibility, but his insurance company(Access) was too slow to repair my car for me, also do not provide rental services, I've been waiting for a month and a half,because my speaking English is so bad, I don't know how to do, please help me!

Yes, the claim representative connect to me already and one month ago he said he will send me a check but I didn’t receive any checks from him, and I asked him why and he said he still need to ask his manager. But I wait for so long time. I don’t know why they just take such a long time, because my car was hit no reasonable when I park at the roadside.

Contact your state insurance commissioner. You can find out how to contract on line. I had a similar problem and my commissioner straightened it out in a couple of days.

Yes I did, it asked for $5000,and a month ago the insurance company called and said they will send me $2300(check) in 7-10 days , but I didn't receive any checks from them.:(

All good advice. I’ve had my car totaled twice. My insurance company took over, told me what to do, got me a rental car, and pushed the other driver’s insurance company to pay for things as we went along. Since it was clear who was at fault, I actually ended up with a much better car than the one I lost, without much expense to myself.

That’s because I have a really great insurance company (Amica). They are very helpful. hopefully you have a good one, but if not, then you need to get the state insurance powers to intervene and make them do their job.

Insurance companies are regulated in each state. The Insurance Commissioner’s office oversees them and can pull their license to do business in your state. That is why I recommend you visit them with your complaint about lack of service on your legitimate claim.

They carry a big stick!

Get a lawyer... the kind that offers to 'not charge you unless they collect'.

Ask if there's a charge for the first appointment... The first visit should be free.

Then check your own policy and see if you have 'uninsured motorist' insurance - - it's the most important addition to a policy. Why? Because you're much more likely to be hit by a person who is NOT insured. Why? Because they're not insured because either they're irresponsible or they've had so many accidents they can't afford insurance.

I've never been in your situation so I'm not sure the order... but if you go to see a lawyer have a list of 3 or 4 questions. You can always go to another lawyer with a different set of 3 or 4 questions... until you have an idea of what to do.

Thank you for your reply. Yes, I take my car to the shop for an estimate already, and the insurance have come and taken photos too, anything is no problem, the only problem is them work to slow, because last time them call me and said they will send me a check in 7-10days but one month pass, I didn’t receive any checks from them, because I need to work, I can’t wait so long time. I can use my own I insurance to repair my car but I need to pay $500 by myself, And my insurance will increase next year too, so I don’t want to do that.:(

Thank you for your reply, the at-fault driver’s insurance company is agree to pay the money but they are very slow to make it work, one month ago they told me that they will send me a check, but I didn’t receive any checks from them.

The advice you are giving is VALID only if he has PHYSICAL DAMAGE/COLLISION coverage in his auto insurance policy. If he only has liability coverage, his ins company is not going to do diddly squat for him. GOT THAT?

Normally, the negligent driver’s PROPERTY DAMAGE LIABILITY responds to situations like this, based upon there being a clear case of NEGLIGENCE in causing the accident. Insurance agent’s accept claim reports from their customers but normally have no authority to handle/settle/pay claims, especially liability claims which involve proving negligence of the insured driver caused the accident.

If the third party ins company is slow to pay or declines to pay, then if he has collision insurance coverage in his policy he submits the claim to his carrier for payment of damages minus the deductible. Having paid the claim the ins company will then SUBRAGATE the paid claim to recover the paid claim and usually includes the deductible incurred by the policyholder on behalf of their policyholder.

If after going through all this, he still has problems, then calling the insurance commisioner’s office for assistance is the next step to take. If this does not work, then he seek legal counsel to sue “the bastard” and pay the lawyer for his service and time.

These are the steps followed during my 25 years as an Independent Insuranace agent which are still probably being followed at this time. GOOD LUCK...

Your insurance company should be handling this matter, not you. They pay for damage and rental car, then in turn your insurance company is reimbursed by the insurance company of the other driver who hit your car.

If you’ve been without transportation for weeks due to insurance companies taking too long to settle over this accident you’re owed compensation for that as well.

The insurance company you are dealing with (Accesss) appears to have a shady rep. They are low-balling you, and you will get a far better settlement dealing with your own insurance. Use your insurance company. Pay the $500 deductible and get your car fixed right. Your insurance company will go after Access (assuming you have a good insurance company). Once they get paid, they will refund your deductible. They will NOT raise your rates. This is why you pay for insurance.
