It’s something we all fear. My deed restrictions say no fireworks. Yet I can’t get the HOA to put two signs up at the two entrances. They told me they’ve done it in other neighborhoods all to no avail. Bottom line us the only deed restrictions that can be enforced are if there are city or state laws being violated.

If the deed restrictions clearly state this guy is in violation, they should take him to court but their lawyers are probably telling them they can’t win.

But they can take your house if you don’t pay the fees.

Finally, be prepared. There are many on here who don’t believe in HOAs.

Problem might be the bank is not willing to sell at a large loss over the loan amount, is what I heard.

The other issue might be that the mortgage takes priority over the unpaid dues under the laws of your state. So if the bank is holding a loan of $120,000 on a condo that they can only sell for $100,000 then they would sell the condo, write off a $20,000 loss, and the unpaid dues would never get paid because they didn't sell the condo for enough money to pay even one penny of those dues. So even if the association foreclosed on the condo, they'd have to satisfy the mortgage lien first anyway. In that case, the association might be better off NOT foreclosing on it.

I don’t like HOAs but I would always stand up for someone who lives in one and expects its management to meet its obligations.

I am dealing with the same thing but found out tonight the man with the junky backyard is moving. Hooray! Our enforcement office lives on our street and did nothing and when she retired some things finally were rectified. If you call the Health Dept. they may have to come out to check things out - that’s what a neighbor in Los Angeles always did. And it worked!

That sounds like vandalism, trespassing, and is clearly a violation of private property rights.

Committing crimes in order to get someone to cleanup their yard seems excessive. Jeez...

I said as a last resort... sheesh. I recommended just going over and addressing the situation.

It is like the lady that walked her dog and it crapped in my yard at least 3 times a week. I walked out and told her she was a rude pig for letting her dog crap in other peoples yards and not picking it up. She went off on me. Said she was going to tell her husband on me and he would come over and kick my ass. Next day when she came around she had the baggy. Now I just wave at her when I see her. No HOA needed.

One. Make sure you are prepared to go to war and that’s what you want. It is hell living next to a neighbor youre at war with. Is the eyesore worth war?

It always amazes *and* mystifies me that people who identify as "conservatives" support either and/or both.

No sympathy. If the neighbor has title to his piece of land, it is strictly his business what he does with it. Personally, I would not ever move into a neighborhood with an HOA. The HOA effectively owns all the members’ lots and houses and that means that two or three a**h***s, er, caring sensitive people get to make the rules for everything down to sharing the air. If someone else can tell you what you may and may not do with your property it is not your property. You get to stay there if the HOA has no objection and you get to pay the RE taxes on it.

Mine is selective in what they enforce. There are company trucks parked in some driveways. Nice looking vehicles...So far. So what will they do when a guy starts parking his dump truck or 18 wheeler? I’m afraid they’ve set a precedent.

But leave your garbage can out for more than 24 hours and you’ll get an email with a picture of the can attached.

I like the HOAs for the reason such as I don’t want a dump truck parked in front of my house or the neighbors raising pigs. I mean, I’d love to have a few chickens. Love me some farm fresh eggs with orange yokes. But I’m sure not everyone feels that way.
