MORE ON THE OBAMA 9TH CIR JUDGE WHO SEEMED TO SLAM THE ORDER

On August 1, 2013, President Barack Obama nominated Friedland to a seat on the United States Court of Appeals for the Ninth Circuit. She fills the seat that was vacated by Judge Raymond C. Fisher, who took senior status on March 31, 2013On January 16, 2014, the Senate Judiciary Committee voted to forward her nomination to the full Senate in a 14-3 committee vote.

Cloture was filed on her nomination on April 8, 2014. On April 10, 2014 the motion to invoke cloture was agreed to by a vote of 56-41. On April 28, 2014 her nomination was confirmed by a final vote of 51-40.She received her judicial commission on April 29, 2014.

Justice Sandra Day O'Connor administered the oath of office to Judge Friedland at her formal investiture on June 13, 2014, in the James R. Browning United States Court of Appeals Building in San Francisco.

Friedland is currently the youngest serving federal appellate court judge in the nation. At age 41, Judge Friedland ranks fourth among the youngest appointees to the Ninth Circuit Court of Appeals. On February 4, 2017, Friedland and Judge Canby accepted an emergency motion by the Trump administration for a stay of the temporary restraining order in State of Washington v. Trump, part of the ongoing court cases related to Executive Order 13769. The stay is to be reviewed by Canby, Friedland, and Judge Clifton Friedland is married to Daniel Kelly and lives in Mountain View, California.

What do Freepers think he should do, hope he should do at this point?

Will he prevail once the new judge is appointed? And how long can Democrats keep him off the bench? So part B, would be a momentary retreat, and let’s say tackle funding to Planned Parenthood. That will get their heads spinning.

Second idea. Trump is the Executive. Can he not just ban travel at his whim. How about what appears to be a totally random ban, starting with a handful of countries, and adding to the ban monthly. Could start with China, Canada and Iraq.

Trump should tell the court that they have no authority over his executive decisions concerning the allowing of citizens of other nations entry to the US.
These states have no standing in this matter. And this court has no basis for interfering in issues that are outside their jurisdiction.

exactly and why was the lawyer form the DOJ who sounded useless not saying this and presenting the law before these 3 judges?

Sessions needs to get in that DOJ and have a clear out.

Friesland seemed to want the DOJ to make the plaintiffs case for them. She really went after Fientje. Constant interruptions.

This whole thing has really devolved into a farce. All anyone needs to do is hold up a copy of the Constitution and highlight article I, section 8, point 18:

It's hard to fully grasp how ridiculous the plaintiff's assertions are. In effect, the states are saying it's unconstitutional (!) for Congress to enact laws (which the president is charged with executing) covering border control for purposes of national security.

Let that sink in just a little bit. Consider the risk the judiciary is taking granting this argument with even a hint of legitimacy by actually conducting a hearing on the matter. They've damaged themselves already by not summarily dismissing it with extreme prejudice.

Amazing she seemed to feel she is completely entitled to review Presidential decisions despite having none of the intel which form those decisions. If there was ever a court ruling to completely ignore, it’ll be this one.

There's a pretty good argument at National Review that Kennedy would rule against Trump based on his confabulations in Boumedienne, which basically extended habeus to the whole planet.

My guess is the administration would lose 5-3 at the SCOTUS.

Trump needs to tell the judiciary to pound sand.

Washington will have a hard sell in front of the USSC even with 8 justices.

That isn’t true. The four liberal justices will vote their ideology. When haven’t they in the past? Which one won’t? Kagan? The Wise Latina? Buzzi? Breyer? So the courts will be saying the president has no authority over immigration, when that’s what the law explicitly says. We are heading for civil war, friends.

Kennedy WILL NOT uphold this ruling. He might sway left on social issues, but he has been pretty steady on the delineation of powers and he also understands better than most the kind of anarchy such a decision would create. It would be a defacto elevation of the judiciary above the other two branches. It would immediately create a Judge shopping bonanza and multitudes of lawsuits over everything.

The law is clear. The delegation of power and authority is clear. The precedents are clear. This might not even make it past the 9th Circuit.

Also remember something else that may influence the decision by the 9th Circuit. The call to break up the 9th Circuit (it is by far the largest) have grown in recent years. The President can lead the charge to create a new Circuit court and take half of what is now the 9th Circuit likely appointing the majority of the Judges to the new Circuit. Politics of this kind are not supposed to impact a court, but they likely do.
