When a dolphin died in New Jersey's South River last year, Carly Sitrin wanted to know what killed it. So she filed a public record request to the NJ Department of Agriculture in order to get the necropsy results. The DOA finally responded last week with the weird decision to deny the release of the record on grounds of medical privacy. The response reads in part:
"We are in receipt of your request for information (#W101407) under the auspices of the Stateâs Open Public Records Act (O.P.R.A.). Specifically, you requested any and all reports associated with the necropsy of the dolphin that strayed into the South River on August 5, 2015 in Middlesex County, New Jersey. This request is denied as it would release information deemed confidential under O.P.R.A., specifically information related to a medical diagnosis or evaluation. (E.O. 26, McGreevey)"

Medical records are to be shared ONLY among the agencies of the various levels of government.
This information can be used to catch you in insurance fraud, to catch tax cheats, to increase the charge of insurance policies, to deny applications for insurance policies, to increase the cost of government-sanctioned health coverage, to deny health coverage based upon lifestyle and...

to deny citizens the right to purchase firearms.
For a peon to request medical information — ANY type of medical information — of The State is to stick your nose where it does not belong.
The person who filed a request for this information can expect a tax audit for even daring to peak behind the curtain of The State.
“No dolphins were harmed making this decision”, the spokesperson said.
I am reminded of a time not too long ago when you could not even request a copy of your own medical records, even from your own doctor.
Can’t wait until they use the same justification for not allowing you to view the results of a pet’s medical exam or autopsy (necropsy?)!
The only person HIPAA prevents from seeing your medical records is you.

You’re not kidding. If I want to see my med tests from.my dr I have to sign up for their portal website. Sorry but indent want my stuff going across the Internet.
