I don't know what the law says about such a situation but this sounds kinda dicey to me.But if a reputable structural engineer (or,better still,several of them) decide that that tree is,in fact,causing serious damage to that home then one could argue that it's up to Lennon to address the situation.

Once the roots enter the Tomei’s property, aren’t they free to cut those roots? It looks like a mater of simple maintenance to me but, among the privileged elites nothing is simple, I suppose.
