FULL TITLE: The moment woman jogger in headphones is knocked to the floor and handcuffed by cops because she didn't hear when they tried to ticket her for jaywalking

A female jogger out for a run in Austin, Texas, Thursday was arrested, handcuffed and hauled into a police cruiser screaming and in tears for allegedly failing to identify herself.

The entire incident was caught on video recorded by Chris Quintero, a student at University of Texas who was sitting in a cafe across the street and witnessed the woman being taken into custody.

The arrest took place just before 11am outside a fast-food eatery near the intersection of 24th Street and San Antonio Street in Austin.

The force was not, in my humble opinion, excessive. She refused to stop. She refused to identify herself. She broke away and tried to flee. She needed to be subdued to protect the officers trying to ticket her, to protect her, and to instill some respect for the law into her. If she had been hit by a motorist, she would likely have called her attorney from the ambulance. I doubt the fact that she was crossing against the light (what we used to admonish young children not to do as "darting out into traffic") would likely not have protected the motorist from financial ruin. I will admit I have narrowly missed running over joggers like that young twit girl who have flipped me the bird while darting out into traffic. One of these days one of those fool joggers (who weren't doing anything wrong) are going to be turned into hood ornaments. Frankly, I will shed more tears for the motorist than I will for the jogger when I shed my first tear for the motorist.

The other side of the coin, as put forth by one of the commenters:

In this area there are over 100K students and traffic problems are constant. Pedestrians (mostly students) show no regard for any laws and navigating around is a royal pain and makes driving in that area a complete nightmare. There are complaints made and without them our police have to deal with them. No regard for laws, no respect for drivers and all seem to be completely above the law. Not 24 hours after this recording a student was killed by a bus while jaywalking in the early hours of morning. They literally do not care where they go and how they do it and it’s a chronic problem.

The police officer grabbed her hand from behind. She pushed his hand away. That is not refusing to stop. If a person had grabbed my hand from behind, my first instinct would be to immediately turn around and kick him/her in their privates. You don’t do that to a person without expecting a physical reaction.

It’s called self-defense.

TITLE 8. OFFENSES AGAINST PUBLIC ADMINISTRATION

CHAPTER 38. OBSTRUCTING GOVERNMENTAL OPERATION

Sec. 38.02. FAILURE TO IDENTIFY. (a) A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information.

(b) A person commits an offense if he intentionally gives a false or fictitious name, residence address, or date of birth to a peace officer who has:

(1) lawfully arrested the person;

(2) lawfully detained the person; or

(3) requested the information from a person that the peace officer has good cause to believe is a witness to a criminal offense.

(c) Except as provided by Subsections (d) and (e), an offense under this section is:

(1) a Class C misdemeanor if the offense is committed under Subsection (a); or

(2) a Class B misdemeanor if the offense is committed under Subsection (b).

(d) If it is shown on the trial of an offense under this section that the defendant was a fugitive from justice at the time of the offense, the offense is:

(1) a Class B misdemeanor if the offense is committed under Subsection (a); or

(2) a Class A misdemeanor if the offense is committed under Subsection (b).

(e) If conduct that constitutes an offense under this section also constitutes an offense under Section 106.07, Alcoholic Beverage Code, the actor may be prosecuted only under Section 106.07.
