The University of Texas at Austin is suing ONeal to try to gain possession of the portrait. Fawcett left all her artwork to the school and it claims ONeal improperly took it from her condo days after her death.
The Oscar-nominated actor took the stand for the second time in the trial to assert his ownership of the portrait and why its important for him to keep it.
I talk to it, ONeal said. I talk to her. Its her presence. Her presence in my life. In her sons life.

Well...there is the matter of her will. Courts tend to give great deference to a person’s testamentary instructions.

(This is not a statement of fact. It is either opinion or satire; or both.)
To: BenLurkin
True, but no art works are created for museums or universities (unless explicitly ordered by such.)

He misses her so much, the painting worth millions is needed for purely sentimental reasons...

As one FReeper put it earlier, the university should just delay possession until after Ryan dies.
She gave the painting to the University.
We all know that the courts are neither nor just.
They simply apply the law, whether it be good or bad.

Exactly.
That would be a fair compromise.

>>Visiting a grave seems normal, but talking to a painting, I don’t know. Of course, I’m talking about loss of parents, which again is ‘normal’, where loss of a wife or husband or ‘life partner’, or child for that matter, is not.<<
Either way, they are real life symbols that enable our connection. We imbue and impart meaning to these symbols that help us in this way.
It strikes me the University is being pig-headed.
If I was arbitrating this I would simply grant ownership to the University but custody to O’Neal until his death.
Having worked for several Colleges and installed and built giving systems, I can assure you that assets are booked for the long haul.

I do not believe that she gave THAT piece to the museum. And he commissioned the works to start with.
To: Sacajaweau
The story says she did will it to the university.

That’s what the case is about....whether it was actually hers to will. There are witnesses that say “she said” it was his. Unless there was an actual inventory attached to the will, that testimony will hold a lot of weight.
To: Sacajaweau
Well I guess he has to duke it out.
