The alleged Boston Marathon bomber who hid from authorities for more than 20 hours was captured tonight by police, sending cheers up through the Watertown neighborhood where he was found.

Dzhokhar Tsarnaev, 19, was discovered by a homeowner lying in a boat in the man's backyard around 7 p.m. The man noticed blood on the boat, spotted a body inside the boat and called 911, according to Boston Police Commissioner Ed Davis.

According to police, a helicopter with infrared technology then located Tsarnaev in the boat and noted that he was moving about within it. The helicopter directed officers on the ground to the boat, where they briefly exchanged gunfire shortly before 7 p.m.

In an earlier FR thread it mentioned he was naturalized on sept. 11, 2012. He can’t be sent to Gitmo because he’s a U.S citizen and he can’t be stripped of his citizenship until he’s convicted.

Would like to be in control of his meds.

Whatever became of "truth serum", anyway? I thought sodium pentothal (sp?) was supposed to have the effect of both a pain killer and a tongue loosener.

They have to be mirandized before they anything they say is used against them.

But only if they say it as a response to questioning, IIRC.

And since this terrorist is being treated as an American citizen, won’t this be due cause for dismissal by all the lawyers who will be falling over themselves to represent this guy?”

And by failure afford the defendant his miranda rights ,the concept of ‘ due process’ and avoiding self-incrimination as guaranteed in the 6th and 14th amendment to the Constitution are now invoked against an AMERICAN CITIZEN.
Don’t be concerned ~> it’s just another attack against the Constitution
and will be used to establish legal precedent against an American Citizen ,
on American soil, in other subsequent legal proceedings.

You are correct. As an American citizen he is due all the rights of citizenship. But, I do feel that if it is proven in court that this young man did do what he is accused of, which is Treason against the United States, that he should be treated as an enemy combatant and an attempt made to get as much information from him regarding other terror cells, how he and his brother were trained, funded, ties to international terror groups, etc.

In other words, is there a point at which, once an American citizen has been convicted of treason against his/her country, has killed other American citizens - can they be regarded as combatants, or is that never an option? Not a hostile question, just curious.

To call the Miranda ruling a “right” is an invitation to let savages like this little animal to go free. Don’t you think it should be the citizen’s responsibility to know their IV, V and VI ammendment rights without having to be reminded of them? I’ve read them, they seem pretty clear to me. You can’t search my home without a warrant signed by a judge, I don’t have to talk to you without knowing why you’re holding me or without counsel, and you have to present your case against me, faced by my accusers in front of a panel of my peers and prove my guilt beyond a doubt. Much as we hate to admit it, this Chechen b@stard is a citizen of this country and should be secure in those rights. Just because we don’t remind him of that doesn’t mean he can go scott free. And if he blabs to the cops without counsel thats his problem.

I also need to add to my previous post that just because a citizen is not reminded of his rights does not mean he is stripped of them.

This is more than not being mirandized, this is stripping him of his rights. We don’t suddenly “poof” obtain the right to remain silent only after we’ve been mirandized.
