Vanity: If Obama loses can he still be impeached?

Say Obama loses the election and then these emails that Gingrich are talking about surface. And then eventually the videos come out.

Obama has LIED to the American people just like Clinton. Even though he wouldn't be around can elected officials still vote to impeach him? Even though it wouldn't be knocking him out of office per se? Just a mark on his record?

What are the ramifications of impeachment?

Clinton wasn’t “found innocent”, he was not convicted because a majority didn’t find him guilty. On the third count of the indictment, there was a 50-50 split.

I'm no lawyer, but I would think that after he leaves office that the families of those he left to be butchered might want to pursue civil charges for criminal negligence as well as charges of malfeasance. Waiting until he leaves office should make him have to defend himself, rather than use his puppets at the Dept of inJustice.

The smoking gun would be if they can uncover proof he supplied weapons to radical muzzies, then the government should pursue charges of TREASON. In the very least, all pension, benefits, SS protection, etc. should be revoked. Granting immunity to the 'Beast may be the easiest way to get the evidence needed to put him in Gitmo.

As far as military punishment you think he could be sent to Gitmo while waiting punishment? Or since he would be convicted after his term ends maybe he would be tried in a civilian court?

Presidents have been sued before. But treason is a federal crime and would not be prosecuted by a state.

Look at the quote I gave from Article I, Section 3, 7:

“Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to indictment, Trial, Judgment and Punishment, according to Law.”

The Constitution allows any impeachment judgment up to and including removal from office and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States.

IMHO, that seems to say that somebody who still has the honorary title of President Bush, President Clinton, President Obama, etc can be disqualified from holding that office of honor under the United States through impeachment. Other than that paragraph I don’t see anything that defines what impeachment is or who can be subject to it.

What am I missing?

Yes, the Senate has three options after a conviction:

1) Conviction in public of the offense(s) charged as sole punishment.

2) Conviction AND removal from office.

3) Conviction AND removal AND disqualification from future service.

The Constitution, Article I, Section 3: The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present. The House did not "try" him. He was brought up on charges - in today's lingo, Indicted. The Senate voted not to convict (requiring a 2/3 majority)

The congress can choose to disqualify an impeached official from any future office but on occasion has not done so. It is not an automatic result of the process.

It won't happen.

In theory it could happen until the next president takes the oath of office but the timeline is too short and the only punishment available is removal from office upon conviction by the senate.

Do you have some reason want a Biden presidency even for 60 seconds?

The Senate tried Clinton for perjury and obstruction of justice, but they did not get the two thirds vote to convict him.

Read the Constitution.

Impeachment can result in removal from office, and that is all.

I guess the attractive part of impeachment would be possibly barring obama from future elected office and taking away any benefits he might be getting an as ex president

Thank you! And keep the pressure on over time, hold them accountable. That is the political remedy. I would love to see the T word executed, I believe it is fully warranted, for his minions as well.

What you’re missing is that the honorary title “president” holds no power or privelege under the United States, and is not granted in any official capacity by the people. We call people president, senator, governor, judge, out of respect for the last office they held. There is no “office of ex-president” from which a president can be removed. If there are any priveleges granted to an ex-official, those priveleges can be revoked by law.
