Suspect in police shooting says he feared for life

A man accused of fatally shooting a police officer and wounding five others during an Ogden drug raid last month says he feared for his life because he thought people were breaking into his home to rob and kill him.

Matthew Stewart told The Salt Lake Tribune (http://bit.ly/zMxrig ) that he never heard the drug strike force members identify themselves or announce they were at his home to serve a search warrant the night of Jan. 4.

Stewart, in an interview Friday at the Weber County Jail, said he was asleep when he heard his alarm clock and then a noise that sounded like glass breaking. A shootout between the suspect and officers followed a short time later.

"Some parts I remember vividly. Other parts it was like I was running on instinct," he said. "When you're convinced that you are getting robbed and most likely killed by a group of armed men, your instincts kick in."

I am very much pro-police, but I can’t for the life of me understand how I am supposed to differentiate between real police and thugs who yell “police” when my door is busted down in the middle of the night.

Anyone can yell “police.”

They have got to quit this stuff. It is not workable and law-fearing people are going to end up hurting or killing cops even though they don’t want to. It is wrong.

A good guard dog in the dark can be a fearsome opponent.

True story, many years ago when lived in Phoenix, we had gone on a overnight trip. When we got home next day first thing I noticed was the back gate on wood privacy fence was completely off the hinges and laying flat in the alley. And our big male Airedale we had left out in backyard was gone.

Our neighbor then came over with our dog Duke and gave his version as to what happened. Said he was just going to bed little after midnight when he heard Duke loudly bark, screams, accented yelling from different persons and a very loud crashing sound. Duke must have continued the chase, for after neighbor got him under control and called police, they found a bloody ripped up pants leg in the alley.

Police have said officers repeatedly knocked on the door and called inside Stewart’s house before they broke inside

Oh Mr. Stewart, are you home sir?

Give me a break: We have all seen these things go down many times over. For a police officer to claim they stood outside his door and repeatedly knocked while they called out to him is laughable.

They went charging in and got shot.

They could just as easily arrested him when he went to work
and then gone to his home with a warrant to search for his Marijuana plants.

Stewart is lucky to be alive, and probably is because he hit several officers before they could get him. Jose Gorena was shot 71 times by officers of the law. Then laid there for over an hour while they watched him bleed out.

If he’s got a growing operation, he’s got way too much to flush. If he’s got a baggie full, why would you bother with a raid? Just go ahead and knock already.

Or legalize marijuana.

Amazing he didn’t end up dead.

Completely believable defense. While I was in college at the University of Kansas, there was a small time criminal dealing drugs in Topeka, KS who was hit in a "no knock" raid. The drug dealer was not there, but his roomate was, who grabbed an SKS and fired 10 rounds in the door and killed a Topeka SWAT officer.

When they got to court, the jury heard all of the testimony, especially the ones from the neighbors on BOTH sides of the "raid" house. It was hot that evening, and rather early, 9pm or so, so the neighbors on each side of the house testified that they got out of the van, tried to break down the door, and DID NOT, repeat, DID NOT shout "POLICE" nor "WARRANT".

Guess what? The neighbors testimony stuck, and the homeowner was vindicated from police malfeasance. Topeka PD got into even MORE trouble after local TV crews caught uniformed cops bragging after the verdict that they will "get" the guy that killed their fellow brother....one even joking that he would be found with a gun in his hand the next time anyone reads about him.

Anyways, I wasn't at this latest shooting, and don't know the details, but I do know that a homeowner in the mid-90s was allowed to use deadly physical force against the police SWAT team fearing for his life.

If he’s up in a tree with the AR15, *then* you gotta worry....LOL

Don’t worry about the Ball Pythons at all...they can only carry small daggers and they’re really slow slitherers.

When unmarked cars became the rage we had a freak with a stick on flashing light pulling women over and raping them.

I intend to drive to place full of witnesses or the police station if I ever see lights flashing behind me on the nowhere stretches of I70.

If the trooper gets pissed, too bad.

Looking not like real cops was their bright idea.
