Jefferson County judge sets hearing on request to dismiss suit over President Obama's citizenship

A Jefferson County judge today set a Monday hearing on a lawsuit challenging President Barack Obama's citizenship and right to be on the 2012 ballots in Alabama.

Circuit Judge Helen Shores Lee will consider a request by Mark Kennedy, chairman of the Alabama Democratic Party, to dismiss the suit filed against him on Dec. 14 by Birmingham resident Albert E. Hendershot.

The hearing will start at 9 a.m. Jan. 9 in Lee's Birmingham courtroom.

Hendershot wants Lee to issue an injunction blocking Obama from being certified as a candidate in Alabama. His suit claims he has "staggering evidence" that Obama is using a forged birth certificate and a false Social Security number.

"Barack Hussein Obama II is not a natural born citizen and is not qualified to be on the ballot as a presidential candidate," Hendershot wrote in his suit, which he said is part of an informal effort in several Southern states to keep Obama off ballots in those states.

Worse than that. She's a Democrat that went through social services employment (as a clinical psychiatrist) before becoming a judge. She is also black, and seemingly harbors racial resentment.

Breaking point

She reached a breaking point one day when a group of white kids in a car began circling the block around her family’s home. They stopped many times in front of the house and, each time told the family to “go home” while using a racial epithet.

Her father told her to ignore them, but Lee, then 12, decided otherwise.

“I tried to ignore them, but they didn’t go away,” Lee said. “Unbeknownst to my father, I knew where he kept his Colt 45 in the house. Quietly, I went into the house and removed it from its holster. I came back on the front porch and waited for them to come back down the hill again,” she said. They did, shouting the same obscenities. “I stood up, took aim and as I prepared to fire, my father saw me and deflected the shot in the air,” Lee said.

He told her that if she had hit one of the group, she would likely have spent the rest of her life in prison.

Lee grew up angry because of the violence her family faced.

How is it that every time a “conservative” issue goes before a court it is always assigned to a “liberal” judge, but not the other way around.

Conservatives need to do exactly what the Lberals do...they Judge Shop! And if they dont get the judge they want, they simply dismiss their own case and re-file at a later time until they get the judge they want.

It seems like every Obama Eligibility case, Immigration Law Cases, etc. goes before a minority Obama or Clinton appointee

The Myths Continue

Last year the White House released copies of Obama's long-form birth certificate saying he was born in Hawaii in 1961.

Wrong-o. Was a copy of material abstracted from "data on file" at the Hawaii DOH. The WH apparently re-copied it on some more "official" looking stock, and allowed the MSM to call it a copy of the Birth Certificate. It is not. It is, repeat, an ABSTRACT.

Federal judges dismissed lawsuits in 2008 and 2009 challenging Obama's citizenship and right to serve as president.

Of course, no court has agreed to hear the cases on their merits. All have been dismissed for "lack of standing" and other procedural concerns. As Hendershot is a private citizen, I expect the dismissal will be along similar lines. Although a Judge at this level has the discretion to issue an injunction pending the presentation of the candidates's bona fides, somehow I doubt that will happen.

Were I of a cynical nature, I might even have the wee suspicion of a set-up designed to make the GA case look "racist."

An official of the Alabama Board of Elections (or equivalent) needs to join Hendershot's call for an injunction.

Ah... but we are moving into a different stage of the game now.

BHO, by giving Congress the finger with these illegal and unconstitutional appointments, is seriously moving into “separation of powers” territory.

The Supremes have been more than diplomatic in their relationship with Obama, but I don’t think there is very much love lost in either direction. Obama could be giving them a perfect tool with which they can slap him silly.

This could get interesting.
