STATEN ISLAND, N.Y. -- A Graniteville dad, who burned his young sons hand and forced him naked into an oven last year was sentenced today to four months of weekends in jail and five years probation.
James Moss sentencing came after an emotional plea by his son, Christopher, 11, to spare his father jail time.
"I just cant see my dad taken away from me," the little boy sobbed, reading a prepared statement to state Supreme Court Justice Robert J. Collini. "If hes not with me, Im nothing. Everybody in my family ... is giving him a second chance, will you?"
Moss potentially faced up to seven years in prison. He pleaded guilty in May to all seven counts of an indictment against him, including two of second-degree assault. Prosecutors said he attacked his son because he thought the boy had stolen $20 from his wallet.
In imposing sentence, Collini said he needed to balance the seriousness of the crime against other factors, including Christophers "powerful" statement in support of his father, the trauma the boy has already endured, and his mothers "strong desire" to keep the family intact. He also said the hulking Moss had demonstrated "uninhibited remorse" and had only one prior arrest in 1975 for shoplifting.
"This court feels compelled to temper justice with compassion," said the judge.

I hope that the judge has to stand for election.
But spank the child, and get 25 to life.
The world really is turned upside down.
I’m sure Dad is probably a paranoid schizophrenic. I have known a couple of people who have grown up under parents like this. They usually attack the oldest child of the same sex - and do horrible things to them, while nobody else in the family complains (because they have accepted the schizophrenic’s “reality” out of fear that he or she will turn on them next).
The judge had a moral responsibility to make this man get out of the house, either by being in jail or by being in residential treatment. Some schizophrenics are very good at appearing normal in very limited circumstances for a very limited period of time, so it’s possible that the judge didn’t recognize this. But just based on what this man did, the judge should have been the adult and said “no” and removed the man from the home.
Unfreakin believable. I’ll bet there has been years of emotional abuse, if not physical abuse too. Once the violence occurs, it will not get better without help, and probably not even then.
He should not be permitted in the house without supervision, from someone with a backbone. Maybe a grandparent for example and only very short visits twice a month.
Hadn’t thought about that. And I gotta bad back, too.
How about a baseball bat with RAZOR BLADES.
That would ‘cut through’ the problem..................
what a pathetic judge and what a pathetic system....
For $20? The punishment ought to include everything he had done to the boy and surgical sterilization.
“Barbed wired does get wrapped up in fabric so use caution.”
Forget the nails and barbed wire, just get some duct tape and a handful of pennies, and tape the pennies to the end of the bat. The extra weight on the swinging end will make the thing deadlier than nails or barbed wire.
Can we say Brain washed?
