Is President Obama About to Use an Executive Order to Grant Amnesty to Illegal Immigrants?

Eight Senators seem to think so. They have sent Obama a letter asking for a guarantee that he will not use an Executive Order to grant amnesty to illegal immigrants already in the United States:

Numbers USA: Several Senators have learned of a possible plan by the Obama Administration that would provide a mass Amnesty for the nation’s 11-18 million illegal aliens. Led by Sen. Chuck Grassley (R-Iowa), eight Senators addressed a letter to the President asking for answers to questions about a plan that would allow DHS Secretary Janet Napolitano to provide an amnesty if they can’t secure enough votes for a bill in the Senate.

The Letter signed by Sens. Grassley, Hatch (R-Utah), Vitter (R-La.), Bunning (R-Ky.), Chambliss (R-Ga.), Isakson (R-Ga.), Inhofe (R-Okla.), and Cochran (R-Miss.):

I've been waiting on this one.... it takes the S.C or 2/3 of congress to override the E.O.

No, it doesn’t take 2/3 of Congress to override an E.O. Just a simple majority. Congress has 10 days to act or it becomes law. ( I don’t know if it takes both houses to over ride it or just one).

The president doesn’t have the authority to give a blanket grant of amnesty or he would have already done it.

Many think it is as high as 30 million. We will become a one party nation overnight.

How long has this guy been president? Ten years? Fifty? It’s already feels like the neverending term. I wish he’d just decide he’s bored, and retire to write—ah, I mean, engage a ghostwriter for—his third memoir.

Mhmm, this is a bit of constitutional crisis. Clearly, the President's ability to issue pardon's is virtually unchecked. It, for all practical purposes, is absolute. OTOH, the Supreme Court has held time and time again that the responsibility to draft our immigration policy is left entirely to the Congress.

This is a mess. While Obama can't grant citizenship by fiat, he can pardon all those currently in the country illegally, granting them a kind of permanent alien status. They would be very hard to get rid of after that.

Does anyone realize that we are now living under s DICTATORSHIP? What happened to his oath to uphold the Constitution and the laws of the land? One can argue all they want that say this is “technically legal” but it is the Congress that authors LAWS, not the Executive Branch.

Congressional Recourse

If Congress does not like what the executive branch is doing, it has two main options. First, it may rewrite or amend a previous law, or spell it out in greater detail how the Executive Branch must act. Of course, the President has the right to veto the bill if he disagrees with it, so, in practice, a 2/3 majority if often required to override an Executive Order.

If this happens, why bother to pay taxes? There are 30 million that just got awarded citizenship that didn’t follow the law ...

No, that's not quite accurate. Congress can undo an Executive Order with legislation. Of course, that presupposes that the President actually sign the legislation after it passes both houses of Congress. If the President vetos the bill, then it does require 2/3rds to override the Presidential veto. Effectively, it takes 2/3rd to override an Executive Order.

Of course, the Judiciary retains review over Executive Orders, just like they do over all administrative law.

I have speculated for several months, that Obama can grant refugee ‘legal’ residency to everyone who crept over the Mexican border because of the WAR going on there.

A pardon is granted to an individual. It cannot be granted to a group enmasse. Also, a pardon only excuses past crimes, it doesn’t grant citizenship.

Youngstown Sheet & Tube Co. v. Sawyer,

The Supreme Court said that an Executive Order (in this case EO 10340) that tried to MAKE law rather than clarify existing law was invalid. One opinion was that according to the Constitution, Congress had exclusive power to pass legislation.

In a case just 2 years ago, citing the above case, Chief Justice Roberts stated “The president’s authority to act, as with the exercise of any governmental power, ‘must stem either from an act of Congress or from the Constitution itself.’”

The easiest way he can do it is to have the State Dept. issue legal resident status for all of them as ‘refugees’ of the worn torn holes they crawled out of...just like they just did with Haitian illegal aliens.

The real problem here is Congress period, in not doing their jobs and duties;

Congress has allowed all this to happen, beginning with Democratic Socialist Party USA and the Obama candidacy.
