After the U.S. House's historic vote Sunday night passing the health care reform bill, South Carolina Attorney General Henry McMaster issued the following statement:
"The health care legislation Congress passed tonight is an assault against the Constitution of the United States. It contains various provisions and federal mandates that are clearly unconstitutional and must not be allowed to stand.
A legal challenge by the States appears to be the only hope of protecting the American people from this unprecedented attack on our system of government. The key question involved is whether personal freedom, state sovereignty and constitutional law will survive in America for future generations.
As attorney general for the State of South Carolina, I have sworn an oath to uphold and defend both our state and federal constitutions. I therefore intend to join with Florida Attorney General Bill McCollum in challenging the constitutionality of this profoundly unwise legislation. We will take our case to the United States Supreme Court if necessary.
After an extensive conference call tonight, I am optimistic that the attorneys general of Texas, Nebraska, Utah, North Dakota, South Dakota, Washington, Pennsylvania, Oklahoma and Alabama will be joining this effort as well."
We need to encourage threads here on how to attack this thing. Not these rehashes on their victroy dance, posts about foreign countries or other nonsense.
These AGs lawsuits are one way to fight back. We need to come up with as many ways as possible to resist.
We need to work to enccourage and push these cases. A main one that gets fast tracked and then ones in each state. Some strategy. Other people suggested suing Pelosi in every state. Maybe Stupak too.
We have to fight conventionally to get this fast tracked but also unconventionally (legally) but resist.
I think the AGs are on the right track. As soon as anyone sees the brief please post it.

Sorry, after Kelo I have no faith whatsoever in our Supreme Court. If we no longer have private property rights we have lost our Republic. Read Mark Levin's book Men in Black....

Va has the best chance of getting it through to the USSC because of they are under the 3rd Circuit - otherwise known as the Rocket Docket.
The 3rd is THE quickest Court with a reputation for fast tracking - they are the direct opposite of the 9th Circus - while the 9th if overturned repeatedly every year, the 3rd rarely is overturned.

As of yesterday there were at least 38 states that were planning on filing individually or taking part in the Texas/Abbot filing. Some had a count of over 40 states.
With 38 States against this, we can bypass the USSC and go straight to a Constitutional Amendment.
2/3 of the States can introduce an Amendment, the House and Senate at that time must send it to the States for ratification where 3/4 much approve.
Do the math, with 38 we win.
I'm all for every constitutional challenge that anyone can muster. Never said anything otherwise. I'm just not giddy with anticipation that the SCOTUS is certain to overturn this bill. I'll be very surprised if they even agree to hear the case. Even if they do agree to hear it, given the direction that most rulings they have handed down over the past 10 years have gone, I'm not at all optimistic that this will be overturned......

Stupak’s Republican challenger just became one of the most important Republicans in the US (American Spectator quote).
Once the people of Stupak’s district learn of the bribe on top of the pro-life sell out, he should be gone in November (he was a shoe-in to keep his seat before yesterday).
A year late BUT David Horowitz yesterday found a video of Stupak from last year when Health Care first came up for a vote. He didn’t know he was being taped and said flat out he was voting for it, regardless of what it said about abortion or federal funding there of.
I have not checked today the number of hits the video has but yesterday it was going viral.

Can we get 38 or 40 states? Anyone checked on the Constitutional Amendment? We need to resist and fight any and every way we can.

Hummmmm, it’s logical that California would go along with a challenge to this bill since Arnold has indicated that the State can’t handle it. Also, California’s warm weather draws in an enormous amount of senior citizens who then rely on their Medicare.
Good point. We have to get the seniors against this nightmare now.
